Reply:-

 

Please be advised that the information that you have requested is not
available in a readily retrievable format. The information regarding
questions 2 and 3 are not held centrally or in an electronically
retrievable format.

 

There are in excess of 4472 records which would have to be reviewed in
order for us to identify the relevant information for your request. Should
it take approximately 2 minutes per record this would equate to in excess
of 149 hours of work. Therefore the cost of providing you with the
information is above the amount to which we are legally required to
respond i.e. the cost of locating and retrieving the information exceeds
the ‘appropriate level’ as stated in the Freedom of Information (Fees and
Appropriate Limit) Regulations 2004.

 

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for this part of the request and if one part of a
request exceeds the fees limit then S12 of the Act applies to the whole
request.

However, In accordance with Section 16 of the Act I have a duty to provide
advice and assistance in relation to your request and can provide the

I am writing to request an internal review of West Mercia Police's handling of my FOI request 'Serving police staff with criminal convictions' (72029).

I'm disappointed and concerned to hear that your police force does not keep a central record showing all the officers, PCSOs and other police staff who have previous criminal convictions. I am the Investigations Reporter at the Telegraph, and I have put in this same request to all police forces in the UK, and the majority have supplied this information without any such problems. When it comes to publication, as it stands, I will have to contact your press office asking why West Mercia Police feel it is appropriate to not keep a record of police officers, and other police staff, who have previously been cautioned for or convicted of criminal offences.

To avoid this scenario, I politely request that you respond to this refined FOIA request, which ought to fall under your time/cost limits. Regardless of time and cost limits, as above, I am disturbed that this is information you claim to not hold centrally.

With this in mind, please can you respond to the following question:

1. For each PCSO, constable (including specials), sergeant, inspector, and other police staff member who has been convicted of or cautioned regarding a criminal offence, and whom you currently employ, please state:

Your request for information has been considered in accordance with the
Freedom of Information Act 2000 (“the Act”), and I am not obliged to
provide the information requested.

 

S.12(1) of the Act states that a public authority is not obliged to comply
with a request for information if the authority estimates that the cost of
complying with the request would exceed the “appropriate limit”.  For
police forces in England and Wales, the "appropriate limit" is £450 or 18
hours of work as set by the Freedom of Information (Fees and Appropriate
Limit) Regulations 2004.

 

The information you have requested is not available in a readily
retrievable format.  There are over 4500 records.  In order to ascertain
whether the information you have requested is held would take in excess of
150 hours as each record would have to be checked individually.

 

In accordance with s.17(5) of the Act, this acts as a Refusal Notice.

 

Under s.16 of the Act I have a duty to provide advice and assistance in
relation to your request.  Unfortunately, due to the volume of records
that would need to be reviewed I am unable to identify information that
could be supplied within the fees limit as the records of each
officer/member of staff who are currently employed would have to be

You have sought an internal review of the decision made in relation to

Decision of internal review

 

Having reviewed your original FOI request and the reasons for refusal I
have determined that the exemption used in refusing your request for
information and the reasoning given by the Decision Maker are correct.

 

In order to ascertain what information is held in relation to your request
a large number (in excess of 4400 records at the time of your request)
will need to be checked manually.  As outlined in the original response,
this exceeds the appropriate limit for which West Mercia Police is obliged
to respond.  All officers/staff that work for the police must undergo
[1]police vetting but West Mercia Police does not hold a central record of
this information so there is no quick way to respond to your request for
officer/staff conviction information.
