Service and quality of the windows
Dear South Essex Homes,
I'm Michelle one of your tenants and I would like to know about the detailed documents that you have on all health and safety matters of the windows in the Balmoral community. The restrictor's that have been put in place but the Shelter Housing advise line looked up all health and safety matters and could not find any mandatory need to fit the restrictor's to our windows. Their is however a work place act from 1992 which states that if restrictor's are needed that you have to assess the person on an individual basis. So for my own information I would like to have the service details of the windows and the law which it stated that we have to have them or risk out tenancy.

Re: Freedom of Information Request
I am writing regarding your request for information, which was received on
16.10.18. I apologise for the delay of this response.
In that request you asked us for information below:
o Documents that you have on all health and safety matters of the
windows in the Balmoral community;
o The service details of the windows and the law which it stated that we
have to have them or risk our tenancy.
I can confirm that the search for the information you requested has been
completed and I can advise you of the following:
o Please find attached a copy of the last service report on your
windows.
o If you are a Council Tenant you are required to comply with your
tenancy conditions. These would have been given to you when you
signed your tenancy agreement and, by signing the tenancy agreement,
you are agreeing to comply with the conditions of the tenancy. As a
landlord, we are required to keep your home in a fit condition, and
your tenancy agreement requires you to assist South Essex Homes in
carrying out its duties. While we would always seek to work with a
tenant, should a tenant refuse access, we would undertake legal action
to gain entry to undertake health and safety works.
o Please find attached a copy of the Tenancy Conditions, where you can
find information regarding ‘Access’ on Page 18.
