Please could you respond to my FOI enquiry with respect for the Nolan Principles, which still applies to not for profit agencies within the UK's healthcare framework.

1) Please provide an outline or audit to best clarify SERCO's contributions and SERCO's particular role in providing NHS healthcare products and healthcare services in the East of England in

(i) 2009 (ii) 2010 (iii) 2011 (iv) 2012 (v) 2012 (vi) 2013 (vii) 2014 (viii) 2015 ?

2) I understand that you have helped organise contracts for NHS services; how many contracts have been organised that have included SERCO in

(i) 2009 (ii) 2010 (iii) 2011 (iv) 2012 (v) 2012 (vi) 2013 (vii) 2014 (viii) 2015 ?

3) How does your organisation ensure that the NHS service contracts that you oversee, continue to protect the most vulnerable patients under UK data law?

4) Has your organisation overseen the contracts for the administration of patient medical records since 2009? If so, please clarify if SERCO was one of those who tendered a contract since 2009?

I understand that the National Award that your agency won for being value-for-money to the NHS means that your audit system would not find my FOIs a challenge. Many thanks.

I acknowledge receipt of your request for information received on 24 March 2016. It may be helpful if I clarify the remit of the East of England NHS CPH (the Hub).

The Hub providers strategic procurement services to customers which comprise of NHS organisations. The Hub organises frameworks primarily for commonly purchased goods and services primarily where there is a benefit to aggregation of spend. The Hub does not purchase goods or services on behalf of NHS organisation: this is done directly between the supplier and NHS organisation using the framework agreement. The contract is issued between the supplier and purchasing NHS organisation. The Hub does not have any responsibilities for monitoring or auditing the operation or actions of other organisations, such as Serco, who provide procurement services.

I believe from your communication that you may believe that the Hub has responsibilities for monitoring or auditing the operation or actions of other organisations providing procurement services to NHS organisations. If I am incorrect then I would of course be pleased to progress your request and identify whether we hold any of the information requested. I have placed your request on hold pending receipt of your response.

Thank you for your enquiry.

In response to your query, I do not believe that the Hub has responsibilities for monitoring or auditing the operation or actions of other organisations providing procurement services to NHS organisations; I'm just trying to ascertain how many levels SERCO operates under within the NHS.

The springboard for my enquiry is following my witnessing perjury and my failure to source transparency on the activities of SERCO within the NHS in your region. It is very hard for a layperson to work out whether private, not for profit or a Public Service is overseeing the provision of healthcare or medicine to the patients.

I hope this makes more sense to my FOI?

is the same building and address as the HQ for NHS complaints and concerns. You share your building with the same team who oversee correspondence from victims of NHS maladministration and malfeasance ? The legal advisors for the NHS are located in your building too.

Therefore, in light of this information, please add this request for clarity to my FOIA;

A) A number of staff responsible for SERCO perjury against NHS patients at Norwich Crown Court are based in the same building as your "HUB"; does Victoria House have a canteen and shared lobby spaces? I respectfully ask for clarification in line with the Nolan Principles and UK data laws which support transparency.

advise as follows.

               RESPONSE: The East of England NHS CPH does not hold any
information to inform a response to this question.

 

2)            I understand that you have helped organise contracts for NHS
services: how many contracts have been organised that have included SERCO
in.

               RESPONSE: The East of England NHS CPH has not organised any
contracts which have included SERCO as a service provider.

 

3)            How does your organisation ensure that the NHS service
contracts that you oversee, continue to protect the most vulnerable
patients under UK data law? 

               RESPONSE: The NHS Terms and Conditions for the Provision of
Services apply to all frameworks implemented by the Hub.  Schedule 3
specifically relates to information governance including confidential
           patient data.  [1]The current version of this document can be
accessed from the Gov.UK website or through this link.  The NHS
organisation using a service through the framework contracts directly with
the            service provider.  For the purposes of the contract the NHS
organisation is the data controller.  Within each NHS organisation there
is a Caldicott Guardian.  This is a senior person responsible for
protecting the         confidentiality of people's health and care
information and making sure it is used properly.

 

4)            Has your organisation overseen the contracts for the
administration of patient medical records since 2009?  If so, please
clarify if SERCO was one of those who tendered a contract since 2009?

               RESPONSE:  I can advise that Serco did not submit tenders
for any procurements managed by the East of England NHS CPH relating to
patient medical records.

RESPONSE: NHS Victoria House is a multi-tenanted building occupied by a number of NHS and public sector organisations. The building is managed by NHS Property Services who would be able to provide you with a list of the tenants based in the building if required. The building consists of dedicated office space occupied by each organisation and some shared areas, including: a communal staff area; reception area; kitchens and walkways.
