My understanding is that you should have replied promptly and, at least, within 20 working days.

For the avoidance of doubt, I would suggest that it is in the public interest that these documents are not redacted.

I also confirm that my request did not specify that the board minutes should be 'agreed'.

I would further remind you that your board has decided that its minutes should be made available in a timely fashion and that I have an email on file from you chief executive that states that this will normally be within two to three weeks of a meeting.

The following information is provided in response to your request for information for the investigating director -

Your board minutes for July 2009 (minute 09/89) state -

On a separate point but in the spirit of openness, it was agreed that draft minutes of meetings of the Board, redacted in line with usual practice, should be published sooner than the current practice that had been adopted when publication began in early 2004. To help achieve this, it was agreed that copies of minutes would be approved by the Chairman and circulated to members of the Board in time to allow any comments from Board members to be taken into account before publication, as a draft, within a few weeks of the meeting.

With the initials NJ/TH as actionees.

I have an e-mail on file dated 23rd July 2009 from your chief executive, Robin Evans. Attached to that email is a letter with the same date and signed by him. Refering to the minute above, the letter says -

The board have now reviewed that policy and decided at their July 2009 meeting that minutes of their meetings shall be published once the draft of them has been approved by the chairman of the meeting. This should normally be within two to three weeks of the meeting.

I am happy to provide a copy of the email and letter on receipt of your email address if you are unable to locate them

In the circumstances, I would prefer the review to be carried out by a board director.

Please do not use this review as an excuse to delay my information request further.

Some 40 working days after this request was made, I am still waiting for the requested documents to be made available to me.

Dear British Waterways Board,

I regret that I have to write to you yet again on this matter.

On the 1st of November, I requested an internal review. Your response stated -

'I confirm receipt of your request for an internal review as you are still awaiting a response to your request for the September 2010 Board meeting minutes. One of BW's directors will conduct the review and respond to you within 15 working days.'

I have asked that a board director be appointed to carry out this review and have provided information requested.

However, it is now 26th November and the review has not been carried out. Indeed I do not know which director is meant to be doing it.

Needless to say, BW have still not provided me with the information requested on 26th September.

May I ask, irrespective of the provision of the information requested and internal review that this matter is brought to the attention of the board at its next meeting so that appropriate action can be taken to ensure that minute 09/89 is properly executed in future and that BW discharges its legal obligations under the freedom of information act.

On behalf of BW, please accept my apologies for not completing the
internal review you requested within the 15 day deadline. Preparing for
the move to civil society, whilst still taking care of the day to day
running of the waterways, means that workloads are very high at the moment
and I am unable to give you a firm date for when you can expect an outcome
from the review. Therefore I understand if you wish to pursue this matter
further with the Information Commissioner's Office.
