7. For all the staff identified in Q6 above – please sate the amount of any redundancy payments, strain on pension fund payments or other payments made when they left.

We write further to your request for an internal review of our response to
your Freedom of Information request, received by email on 18 January 2018.

 

We confirm that we have reviewed your Freedom of Information request,
which was received by email on 19 December 2018 (your Request), and our
response to your Freedom of Information request, which we provided by
email on 18 January 2018 (our Response).

 

As set out in the Response, the information requested relating to the
numbers of staff whose salaries exceed £60,000 per annum, the names of
senior management, key management personnel and senior post holders, and
redundancy payments made to those staff, is reasonably accessible to you
otherwise than under section 1 of the Freedom of Information Act 2000 (the
Act), by virtue of its publication on the websites linked in our Response
and elsewhere. It therefore falls within the remit of section 21 of the
Act and is exempt information. To the extent that some of the information
requested in your Request has not yet been published (i.e. the financial
statements for the academic year 2017/18), this is held by the College
with a view to its publication in December 2018, which future publication
was intended at the time of your Request. Those financial statements have
not yet been approved by the Corporation Board and so it is reasonable in
all the circumstances for that information to be withheld from disclosure
until December 2018. All three of the requirements in section 22(1) of the
Act are therefore met and this information is also exempt information.
Moreover, it is not our policy to publish information above that which is
already publically available.

 

In relation to point 3 in your Request, I can now confirm that the total
number of individual staff employed by the college in December 2017 was
929. It should be noted that this number is based upon employed staff,
irrespective of the number of hours that they work. If this number is
compared to the Financial Statements it should be noted that the
disclosure is based upon full time equivalent positions and is an average
between the start and end of a 12 month period. This basis forms part of
the audited Financial Statements and is therefore verified by a firm of
Chartered Accountants.

 

To the extent that the information in your Request has not been disclosed
either in our Response or above, it is exempt information by virtue of
section 40 and/or section 43 of the Act. In particular, to the extent that
it is not otherwise accessible to you, the information requested in points
2, 5, 6 and 7 of your request is personal data which meets the first
condition as set out in section 40(3), in that it constitutes personal
data, the disclosure of which to you would contravene the data protection
principles set out in the Data Protection Act 1998. Moreover, the
disclosure of some of the information requested in your Request would be
likely to prejudice the commercial interests not only of the College, but
also of the individual members of staff to whom it relates.

 

Having reviewed your Request and our Response, we can confirm that, to the
extent that the information requested has not been disclosed in our
Request or above, it is exempt information and we are therefore not
required by the Act to disclose it.

The response advised that information requested is available on the
College website, it also provided web links to this information. As this
information can be accessed elsewhere it is exempt information (section 21
