Further to our acknowledgement of your request for information, I have
been asked to contact you for some further clarification on your request.
Please clarify what is meant by the term "responsibilities" and also does
your request concern Chief Officers or all employees earning over £50,000?
 
I will not be able to take this matter further without this extra
information from you. Please let me know by 16 February 2024.

Further to your response, the information I'm requesting is that required by the paragraph 49 of the Local Government Transparency Code ie

"49. In addition to this requirement, local authorities must place a link on their website to these published data or place the data itself on their website, together with a list of responsibilities (for example, the services and functions they are responsible for, budget held and number of staff) and details of bonuses and ‘benefits-in-kind’, for all employees whose salary exceeds £50,000. The key differences between the requirements under this Code and the Regulations referred to above is the addition of a list of responsibilities, the inclusion of bonus details for all senior employees whose salary exceeds £50,000 and publication of the data on the authority’s website."

Hertfordshire County Council received the following request for
information from you:
 
May I have a list of responsibilities and benefits in kind for all
officers paid over £50k please.

Clarified on 15 November 2023 as:

I'm requesting is that required by the paragraph 49 of the Local
Government Transparency Code ie

"49. In addition to this requirement, local authorities must place a link
on their website to these published data or place the data itself on their
website, together with a list of responsibilities (for example, the
services and functions they are responsible for, budget held and number of
staff) and details of bonuses and 'benefits-in-kind', for all employees
whose salary exceeds £50,000. The key differences between the requirements
under this Code and the Regulations referred to above is the addition of a
list of responsibilities, the inclusion of bonus details for all senior
employees whose salary exceeds £50,000 and publication of the data on the
authority's website.
From our preliminary assessment, we estimate that compliance with your
request would exceed the appropriate costs limit under section 12 of the
Freedom of information Act 2000. This is currently £450.00. We estimate
that the cost will be £3125.00 to comply with your request. We have
decided to refuse the request because Your request has now been considered
and we are unable to provide you with the information you have requested.
It is estimated that for all County Council Departmental staff there are
740 employees whose salary is over £50,000, a central record is not held
of each particular roles responsibility, as a consequence to provide a
response to the question posed, this would require a search of individual
officers files and possibly with the officers themselves, which we
estimate will equate to over 18 hours of work.

Under Section 12 of the Act, the Council is not obliged to comply with a
request for information if the authority estimates that the costs of
complying with the request would exceed the appropriate limit.

At the County Council, all existing roles are aligned to a general
framework (job family). The job family framework at Hertfordshire County
Council is made up of 9 job families. Within each family there are several
levels, and those levels reflect the knowledge, skills and abilities
required to carry out roles within a family. We could provide a the job
family description for the roles that earn over £50,000 per annum.
 
Currently this information is not published as a decision was made that
the County Council should only publish information on the top 3 tiers. If
you would like to raise a complaint that this information is currently not
published on the County Council website, this can be done via the
following address.

If you are unhappy with the way the County Council has handled your
request for information you may request an internal review of the request.
This will be carried out by a member of the County Council Legal Services
Team, who has had no prior involvement with the request. Requests for an
internal review should be sent to the Information Governance Unit at the

in writing your grounds of appeal.

Dear Hertfordshire County Council,

I do wish to appeal. The basis is that the Local Government Transparency Code mandates the publication of the data and I do not believe the costs exemption applies.

In any event it should be possible to publish job titles and bands of pay without incurring the costs you desribe.

If the internal appeal fails then I will pursue this as it is mandatory and routinely published by other large authorities. I do wonder what other mandatory datasets you choose to hide but I'll save that query for another time.

Further to my acknowledgment of your request for an internal review, I
have been accessing the information in relation to this request and I will
require some further clarification. Your original request was for the
following information:

However in your request for an internal review, you stated the following:

In any event it should be possible to publish job titles and bands of pay
without incurring the costs you desribe.

Your original request concerned responsibilities and benefits in kind for
all officers paid over £50,000, however in your request for an internal
review you commented that a list of job titles and the pay bands could be
published without incurring the original time frame that was provided in
response to your original request, concerning responsibilities and
benefits in kind. Can you please clarify if you are seeking to now narrow
your request to job titles and bands of pay for officers that earn over
£50,000 at the County Council? If so then we will be happy to consider
that as a new request for information.
Also in your request for an internal request, is this on the basis that
the County Council does not publish information in a manner that you
believe that it should or that in order to provide a response to that
question, the County Council would go over the permitted time limit
allowed or both points? As was stated in my original response, if you
wanted to make a complaint concerning the non-publication of information
by the County Council, then the correct channel to do so was via
[1][email address]. The internal review can only consider
the handling of your request.
 
I would appreciate your clarification reply as soon as possible, to enable
the correct processing of this matter, in order to meet your requirements.
 
As soon as we receive this clarification we will be in a position to
continue processing your request. If we do not receive a response to this
request for clarification, within 90 days of the date that this
correspondence was sent then we will close this matter.
