To assist you I have broken down my request and added some helpful notes that may accelerate your compliance.

NOTE- A simple E mail to those concerned to confirm or deny, a quick e mail then to your accounts people to see how and where it is recorded for auditing purposes.

NOTE- Something like this must surely be recorded within a policy as HMRC must have been consulted.

I would like an estimate please of the time it will take for you to comply, to assist you I am attaching the following from the Information Commissioners Office Awareness Guidance letter number 11 entitled"Time for Compliance"

A public authority must inform the applicant in writing whether it holds the information requested and if so, communicate that information to the applicant, promptly, but not later than 20 working days after receipt of the request; section 10(1).

I am still waiting a substantial reply from you in relation to this lawful and reasonable FOI request.

The Information Commissioner states as follows(from his Good Practice Guidance Publication Number 4:

"our view is that public
authorities should aim to respond fully to all requests within 20 working days.
In cases where the public interest considerations are exceptionally complex it
may be reasonable to take longer but, in our view, in no case should the total
time exceed 40 working days"

What this states is that you have 20 working days to comply, unless it is exceptionally complex. What I have asked for is not in any way exceptionally complex yet you are now on your FORTY SEVENTH working day.

Given that you are now in direct breach of the ICO the many, many thousands of visitors to this site must now be thinking, what is it you are hiding?

Can you please give me your timescales, trust me, simply ignoring this perfectly reasonable request is not going to make it go away.

GMP acknowledges that it is in breach of the Act with this particular request and is giving priority to rectifying that. The decision regarding disclosure has not been made yet as this Unit is not in full possession of all the data requested. I write regarding your request for information dated 17/04/13 (ref
GSA/1588/13) which was made to Greater Manchester Police (GMP) under the
provisions of the Freedom of Information Act 2000 (FOIA) and further to
your subsequent correspondence to the force on this matter. On 14/06/13
you requested that the force review its progress on the processing of your
request so far as you are yet to receive a response. Please accept my
apologies for the delay in providing you with a response to your request
and a response to your request for a review, I have now undertaken the
requested review and have detailed my findings below.

 

Regrettably the force is still yet to provide you with a response to your
request and is therefore in breach of the requirements of the FOIA in
respect of the processing of your request as GMP has failed to respond
within the statutory 20 day processing period.

 

Having reviewed the notes held with the relevant record (ref GSA/1588/13)
I have established that upon receipt of your request enquiries were
promptly sent to the relevant business areas within the force that may
hold the requested information. These enquiries requested that searches be
undertaken to determine whether the requested information is held by the
force and where held copies of the information be supplied to our unit if
the information can be located and extracted within the relevant time/cost
threshold (18 hours). The enquiries requested that the business areas
provide a response to our unit at the earliest opportunity and in any
event within 14 days in order that we would have sufficient time to
undertake any necessary assessments and provide you with a response within
the statutory time frame.

 

Unfortunately our Unit is experiencing difficulties in obtaining from the
relevant business areas confirmation as to whether the information is
held, and if held copies of the information or confirmation that the
information cannot be retrieved within the time/cost threshold, several
follow up enquires have been made but at present we are yet to receive the
requested response. The relevant business areas have been informed that
GMP is in breach of the requirements of the FOIA in respect of the
processing of your request as the force has have failed to respond within
the statutory 20 day processing period and we have requested that they
provide the required response to us as matter of urgency.

 

I can also confirm that I have personally sent further communications to
the relevant business areas again requesting that they contact our unit
and provide the required response without further delay.

 

On behalf of the force please accept my sincerest apologies for the
continued delay in providing you with a response to your request. Please
be assured that our unit is actively attempting to progress and conclude
the matter and that we will endeavour to provide you with a response at
the very earliest opportunity.

 

Following receipt of your response if you remain dissatisfied with any
aspect of the processing of your request please do not hesitate to bring
this to my attention and I will address any issues raised.
