Dear University of Gloucestershire,

I am writing to request information under the Freedom of Information Act 2000. In order to assist you with this request, I am outlining my query as specifically as possible.
I would like to know the yearly salary of the deputy vice chancellor/s and how much that has increased since 2012, year-to-year.
I would be interested in any information held by your organization regarding my request. I understand that I do not have to specify files or documents and that it is the institution’s responsibility to provide the information I require. If you need further clarification, please contact me by email.
I would like to receive the information electronically.
If my request is denied in whole or in part, I ask that you justify this by reference to specific exemptions of the Act. I will also expect you to release all non-exempt material. I reserve the right to appeal your decision to withhold any information or to charge excessive fees.
I would be grateful if you could confirm in writing/by email that you have received this request. I look forward to your response within 20 working days, as outlined by the statute.

Your request is being handled under the Freedom of Information Act 2000
(FOIA). 

Please find below The University of Gloucestershire’s response to your
request.

You asked:

I would like to know the yearly salary of the deputy vice chancellor/s and
how much that has increased since 2012, year-to-year.

I would be interested in any information held by your organisation
regarding my request.

I can confirm that the University does hold the information regarding the
annual salary of the deputy vice chancellor.  However, we are withholding
the information as we consider Section 40(2)&(3) – Personal Information
and Section 43(2) – Commercial Interests of the FOIA applies. 

Section 40(2)&(3)  - This information is classified as personal data and
as a result of disclosure, the University would be at risk of breaching
the First and Second principles of the Data Protection Act 1998.  This is
an absolute exemption and therefore there is no duty to conduct a public
interest test.

Section 43(2) – This is a qualified exemption, and requires the University
to conduct a public interest test.

Public Interest Test

In favour of disclosure – The University would assure the general public
that it spends public funds appropriately.

Against disclosure – The University of Gloucestershire is a relatively
small organisation in a highly competitive commercial environment.  Senior
staff are essential for both the reputation of the University and in
attracting funding.  Disclosing this information may leave the University
prone to having its staff approached by other institutions where an
increased salary could be extended.  Disclosing salary information would
likely prejudice the University’s ability to attract the finest staff and
may lead to difficulty in recruiting those staff.
