Our decision on your request
We can confirm that we hold the information you have requested and, to the
extent that we are able to provide some of it to you, this is set out
below, answering each point in turn.
We are unable to provide the remainder of the information to you under
section 40 (personal data) of FOIA. This is because disclosing this
information, even in an anonymised format, would reveal personal
information about the individuals concerned. For more information on why
we are applying this exemption please see Annex A.

Section 40 (Personal Information)
To the extent that the information that we hold contains personal data
about individuals, section 40(2)(b) of FOIA provides that "any information
to which a request for information relates is also exempt information if
the first, second or third condition listed below is satisfied."
We have applied this exemption because the first condition (as stated in
section 40(3A) of FOIA) is satisfied. Some of the information you have
requested comprises the personal data of individuals other than yourself
which, if disclosed, would contravene any of the data protection
principles.
In particular, it would be a breach of the first data protection Principle
as set out in Article 5 of the UK GDPR, to disclose such information, as
it would not be lawful or fair to the individuals concerned to do so.
This is because, they would not have had the expectation that this
information would be disclosed under these circumstances, and therefore
disclosure would not be necessary, or lawful, where none of the conditions
in Article 6 of the UK GDPR have been met.
We are also not able to provide the information in an anonymised format.
This is because the number of individuals involved is low and so
disclosure even in this format is very likely to lead to their personal
information being revealed. As explained above, this would be a breach of
the first data protection Principle as set out in Article 5 of the UK
GDPR.
Section 40 is an ‘absolute’ exemption, and so it is not necessary to
balance the public interest for and against disclosing the information.

I am writing to request an internal review of The Financial Conduct Authority's handling of my FOI request 'Senior HR staff salary and performance grades'.
Thank for the limited release of information. I wish to challenge the refusal to release all and therefore request an internal review.
1. Details of job title, grade, contract status (ie perm, acting up, FTC) , name of individual.
Your refusal of a complete release is contradictory as you already release names of staff at manager grade and above hence section 40 does not apply.
2. Total 2021/22 pay (base + flex + bonus) broken down for each named individual in item (1). Please round to nearest £5k. For reference this is provided by HMT quarterly https://data.gov.uk/dataset/a5ffd07c-e31...).
If for some reason you are not prepared to provide salary information by name then please anonymise item (2)
Your refusal under section 40 may apply but note I said I was prepared to have data anonymised (or even as a summary table). Also please not I was explicit I wanted pay not salary bands.

Your refusal makes no sense. The FCA have introduced a quota for numbers of staff in each performance grade. How can we trust HR if you hide evidence that those who make the rules follow the rules. A summary table would not identify individuals.
Please note section 40 applies to release of personal information, I made it clear in my request I was prepared to have data anonymised. I feel you have failed in your duty to release information.

Freedom of Information: Right to know request
We are writing with reference to your requests for information which have
been recorded under the above reference numbers.
We have considered your requests in line with the provisions of the
Freedom of Information Act 2000 (FOIA).
As you may be aware, Section 8(1)(b) of FOIA stipulates that a request for
information must include the name of the requester.
Guidance issued by the Information Commissioner sets out what constitutes
a valid request under FOIA:

Thank you for your email.
As mentioned in our previous communication, we are keen to ensure that our
resources are employed in processing valid requests under the Freedom of
Information Act 2000 (FOIA) and so, to ensure that your request complies
with the FOIA requirements, we required proof of your identity. This is in
line with the Information Commissioner’s guidance quoted in our previous
communication to you, as requests made under a pseudonym are invalid
according to this guidance.
Please note, since 20 days have elapsed from the date of our previous
email of 30 September 2022, and we have not received any proof of your
identity, we have now closed all requests for information received under
your name.
We will, of course, resume the processing of your requests, once we are
satisfied that a pseudonym is not being used. We will not, therefore, be
able to undertake an internal review of our decision, or engage in further
correspondence outside of FOIA, until we are satisfied this is a valid
request for the purposes of section 8(1)b of FOIA.
If you remain dissatisfied, you may refer the matter to the Information
Commissioner to consider if we have complied with the FOIA requirements.

Thank you for your email concerning my request.
1. Can you confirm whether all persons submitting FOI requests to FCA are now being asked to prove their identity? Or are you only selecting requests which you do not wish to answer?
2. I have contacted the ICO and I would like to state the name Christopher Leatherhead is a pseudonym. I wish to protect my identity as I work as a member of the FCA senior leadership team. I believe using my real name could potentially prejudice my career so hence use of alias. I have seen the information which I have requested and believe it should be released so all staff can view it. If you feel it is appropriate, please refer my requests to the whistleblowing team and we can explore that channel.
3. Alternatively, if you really wish to delay answering my request, I will simply ask a friend to submit the request. The only thing this does is reset the clocks but does does cause more work for all of us and makes you look evasive.
Sorry to be a pain, but I really feel you should get on release the requested information
