Firstly, I apologies on behalf of Wirral Borough Council for the delay in
your response. Secondly, Thank you for your recently submitted Freedom of
Information request.

 

Your questions asked are below, alongside our response. I have highlighted
these in RED for your assistance.

 

1. From 1st January 2018 to 31st December 2018 How many SEND first tier
tribunal requests were made?

Please break down in

Number of refusal to assess?

Please see attached provided for a previous FOI request. This breaks down
the tribunal data over the last few years.

 

2. From 1st January 2018 to 31st December 2018 How many SEND first tier
tribunal cases did the local Authority succeed in defending the
application?

3. From 1st January 2018 to 31st December 2018, How many mediation
sessions did the local authority take an active part in?

The local authority have a contract with WIRED to deliver mediation. WIRED
delivered 44 mediations for Wirral during this time.

 A. How many of these mediation sessions how many resulted in a mediation
agreement?

B) How many of these mediation sessions how many resulted in an
application to tribunal?

As a mediation service WIRED do not collect data on tribunals as that
would involve contacting all clients 6 months down the line to see if
their agreement held up and whether they lodged an appeal and attended a
hearing. The authority also does not collect this data.

 

4. In April 2018 How many Transfer reviews were still outstanding and had
not been issued with a final EHCP?

When I took up the manager’s post in July, there were 8 remaining. I do
not have access to accurate data before then.

 

5. From 1st January 2018 to 31st December 2018 How many annual reviews
resulted in a draft plan being issued as a result of changes made?

It is not possible to provide accurate data at this time, as we are in the
process of transferring data to a new data management system.

 

6. From 1st January 2018 to 31st December 2018 How many annual reviews
resulted in an application to the SENDIST tribunal?

It is not possible to provide accurate data at this time, as we are in the
process of transferring data to a new data management system.

 

7. From 1st January 2018 to 31st December 2018 How many complaints has
WIRRAL council received with regard to SEND issues? From those complaints
how many related to failure to deliver provision as set out in an EHCP?

Can the complaints department provide this information? The SEN Team does
not hold this information, nor has the current management team been in
post for the entirety of the 2018 calendar year.

 

8. From 1st January 2018 to 31st December 2018 What is the total cost to
WIRRAL Council of SENDIST tribunals? Please include legal costs and
travel.

Legal costs not recorded by the SEN Team. The council’s legal team provide
the majority of advice and, on occasion, they seek support from outside
counsel. Would the legal team hold this information?

 

Transport: Authorised travel expenses across that date range may contain
that information. Is this information held by finance?

 

9. From 1st January 2018 to 31st December 2018 What is the total cost of
mediation? Please include room hire and expenses.

Total costs for the delivery of 44 Mediations by WIRED was £16,783.80

Total costs for the delivery of 44 Mediations by WIRED was £16,783.80
