response to your request. This is due to an error within the primary time
recording software utilised by the Council’s legal team that deals with
SEN mediation and tribunal matters.

I am writing to request an internal review of Wirral Metropolitan Borough Council's handling of my FOI request 'SEND Tribunal costs'.

I have asked a simple question that should be easy to collate, I will accept the cost of barrister/s used for tribunals from November 2019, December 2019 and January 2020.

This cost should be accounted and it is very poor financial practice If this is not the case. I am disapointed in the response and the time it has taken to respond.

I would like a full answer and a reason why my request was so delayed.

Thank you for your recent email requesting an Internal Review (IR) of your Freedom of Information request.
As an independent officer, in relation to your request, I have undertaken the review. Please take the contents of this email as Council's response to your IR.

I have ascertained that the Council records the information you have requested within it's Legal Section. It was therefore assumed that the requested information would be simple to retrieve and provide to you.
Unfortunately over the specific time period you have requested, the time recording system within the CIVICA Legal case management was not operationally accurate in it's ability to record our lawyer's time. This is an issue that is currently being addressed by our external providers.

It has however been possible to produce the information for your amended enquiry and the figures are shown below:-
SEN barristers fees:
1.November 2019: £7125.00
2.December 2019: £3135.00
3.January 2020 : £8100.00

The delay in responding to you occurred as colleagues attempted to retrieve the information you requested and then realised that the timeframe you wanted correlated with the timeframe the system was not fully functioning.

The Council aims to answer all enquiries as quickly and efficiently as it is able to and please accept my apologies for the delay which occurred when responding to you.
