Your request has been considered under the provisions of the Freedom of
Information Act. Please accept our apologies for the lengthy delay in
responding to you. Specifically, you have requested the following

How many of these were upheld by SENDIST?

In 2022 there were 24 Refusal to Assess appeals registered against the LA.
6 of these are still pending conclusion, 3 were overturned by SENDIST and
the other 15 were overturned by the LA during the appeal.

 

How many refusal to issue have been registered this year? - SENDIST
Appeals for EHCP

How many of these were upheld by SENDIST??

In 2022 there was 1 Refusal to Issue an EHCP appeal registered against the
LA. This one appeal was overturned by the LA during the appeal.

 

How many contents and placement appeals have been registered this year? -
SENDIST Appeals for EHCP

How many of the parental preference for placement were named? - How many
have SENDIST named parental Prefence

We have taken this to mean that both the placement and other content of
the EHCP were appealed. In 2022 there were 32 appeals registered against
the LA in relation to both the content of the EHCP and the placement. Of
these 32 appeals 23 are ongoing, 1 was decided at a final hearing with the
parental preference of placement being named and on 6 occasions the LA
decided to name the parental preference of placement during the appeal but
without a final hearing needing to take place.
