Dear East Sussex County Council,

Please supply me, under the Freedom of Information Act, the following information:

What are your criteria for people 0-25 years old being eligible to receive a Special Educational Needs and Disabilities (SEND) Personal Budget?

How many individuals in this age range have requested a SEND Personal Budget for each of the following: short breaks; education; and other support since September 2014?

How many people aged 0-25 received a SEND Personal Budget for short breaks, education and other support since September 2014?

How many people aged 0-25 have been refused a SEND Personal Budget since September 2014?

On what grounds are they refused?

Do you have an eligibility statement or policy around accessing SEND personal budgets in your area?

Yours faithfully,

Connie Burbidge

REQUEST

What are your criteria for people 0-25 years old being eligible to
receive a Special Educational Needs and Disabilities (SEND) Personal
Budget?

How many individuals in this age range have requested a SEND Personal
Budget for each of the following: short breaks; education; and other
support since September 2014?

How many people aged 0-25 received a SEND Personal Budget for short
breaks, education and other support since September 2014?

How many people aged 0-25 have been refused a SEND Personal Budget
since September 2014?

On what grounds are they refused?

Do you have an eligibility statement or policy around accessing SEND
personal budgets in your area?

RESPONSE

1.

•  A child or young person must have an EHCP (Education, Health and Care
Plan) that requires High Needs Funding

• It must be agreed that the allocation of a Personal Budget is an
effective way of meeting the child/young person’s outcomes as identified
in their EHCP

• It should be noted that without exception, the Local Authority and its
partners must ensure that public funding is used appropriately and
provides value for money

2.         Families who request SEND personal budgets will be recorded by
the Assessment and Planning Team. Social Care assess separately for short
breaks and will offer a social care personal budget if the case is part of
the current pilot (see question 3 for more info).

Education – two

3.         Social Care are piloting and rolling out social care personal
budgets for families who meet the eligibility criteria for the Children’s
Disability Service and have been assessed and have a support plan. Short
breaks are sometimes assessed as needed but short breaks can also be
accessed through the local offer. The funding stream within children and
families goes up to 19 although the Transition Service works with young
people aged 16-25, the funding after aged 19 comes from Adult Social Care.
The pilots run separately from the SEND personal budget although where
there is a SEND personal budget if there is a social care personal budget
it will form part of the SEND personal budget. All social care services
are costed, those families without a social care personal budget receive
services such as in house residential respite and payments through Direct
Payments

Education personal budget - one

4.         Education personal budget - one

5.         Funding not available to be released as part of therapy
provision block contract. Provision already being provided.

6.         Yes, please find attached.

I hope that this answers your enquiry. If you believe that the County
Council has not complied with the FOI Act in responding to your request,
you may ask for an internal review. If you wish to do so, please set out
the grounds of your appeal in writing to:

Philip Baker, Assistant Chief Executive, East Sussex County Council,
County Hall, St Anne’s Crescent, Lewes, East Sussex. BN7 1UE.

or by email to him at [1][email address]

Please quote the FOI reference number in any communication regarding this
particular request.

If you are not content with the outcome of the internal review, you then
have the right to apply directly to the Information Commissioner for a
decision. Generally, the Information Commissioner cannot make a decision
unless you have exhausted the County Council’s internal review procedure
as described in the previous paragraph. The Commissioner can be contacted
at: Information Commissioner's Office, Wycliffe House, Water Lane,
Wilmslow, Cheshire, SK9 5AF. Tel: 0303 123 1113.  [2]www.ico.org.uk
