note that this is a part response only to your request as we are still
waiting from a response to question (iii), which I have already hastened
and will endeavour to forward to you as soon as possible.
 
In response to your request for information:
 
 
Could you please provide details of:
 
    
     (i) the number of direct payments for special educational needs
granted under the SEN (Direct Payments) (Pilot Order) 2012.
 
Response:  we agreed 1 case for a provision specified in part 3 and over
40 cases for provision outside of part 3 (number of cases in this area
changes but this is a good indicator of the scale
 
    
     (Ii) details of what types of provision these payments were awarded
for
 
Response:  – speech and language (1 case) transport (the other cases)
 
    
     (Iii) copies of any block funding contracts with health service
providers for special educational needs provision
 
Response:  Unfortunately we do not have a response at to this question
present – however, will forward this on in due course.

Thank you for your response.

Could you please clarify how many of the Part 6 transport payments you refer to are direct payments under the Pilot Order. Local authorities have existing powers to make payments to parents/carers in respect of transport. Can you confirm that these payments which would not otherwise be made under existing provisions?

I believe information has been withheld or omitted as the answer in respect of block contracts is not complete for the following reasons:

1. It refers only to speech and language therapy provision. Does Wiltshire Council has a block contract with other health providers for SEN provision, for example, occupational therapy;

2. The local authority must have copies its own block contracts yet it has not provided them. It has offered no reason for withholding them"

Dear Wiltshire Council,

I note that I have not received a response to my request for clarification made on 8th June. Could you please respond?

Further, I note that you have not provided complete information about your block contracts. You have not provided a copy of your block contract with speech and language therapy although you must have one in your possession. Please provide a copy immediately or provide details of the exemption within the FOIA on which you seek to rely. Also, please confirm whether you have a block contract for any other kind of provision, e.g. occupational therapy.

Thank you for your email yesterday. I am sorry that we have not responded to your email of 08 June. I have today contacted the officers who supplied the information initially but unfortunately they are currently on leave. One returns next week so I may be able to respond then, or she may be able to redirect me.

I note that you did not received the Occupational Therapy contract, I apologise for this too. Please find it attached.

I will endeavour to find the answer to your question of 08 June and will respond as soon as I am able.

My apologies for the delay in responding. Further to my email of 02 august, I contacted the relevant officers and they have today provided the following:

Wiltshire have 36 Direct Payments in relation to transport and that these are in relation to an existing policy on SEN transport rather than in relation to a new policy under the pathfinder initiative.
