I refer to your request for information received on 07/06/2019. Please
accept our apologies for the delay. Please see the information below in

Can you please provide the information detailed below:

 

 1. List the number of Companies used for Semi Independent Living Services
and or Supported Living. All open placements in attached spreadsheet;
names of companies have been removed for the reasons set out below.

 

We judge that listing the names of our current providers alongside their
current rates is exempt under Section 43 of the Freedom of Information
Act. Section 43 states that information is exempt from disclosure if its
disclosure would or would be likely to, prejudice the commercial interests
of any person, including the public authority holding it.

 

Disclosure of this requested information is likely to prejudice the
commercial interest of our current providers, as it could weaken their
position in a competitive market by placing market sensitive information
in the public domain, and to which other providers might refer should the
Council decide to negotiate with other providers in the future. Disclosure
would also be likely to prejudice the Council’s ability to secure the best
possible value for any future contracts, as companies may be unwilling to
provide the full information required if they believe this will be
disclosed to competitors.

 

This exemption requires the Council to consider the public interest test
and, whilst the Council recognises the public interest in the transparency
of the procurement process, it must consider the strong public interest in
securing best value for taxpayers. In addition it could be considered that
some of our current providers’ information is provided on a confidential
basis on the understanding that it will not be placed in the public
domain. As a consequence, the greater public interest lies in withholding
these parts of the requested information.

 

Under the terms of the Act, this letter acts as a Refusal Notice.

 

 

 2. What is the weekly charge per company to the council per child for the
Property Cost and Management Services for Semi Independent Living
Services (24 Hour Units) For 16-17-year Olds. All open placements in

the council’s commissioned non 24-hour units, with weekly costs
averaging £400 a week inclusive of rent, targeted staff support, and
emergency response.

Services (Non 24-Hour Units 18-21-year olds – Councils commissioned
non 24-hour units weekly costs average at £200 a week exclusive of
rent, and £400 a week inclusive of rent where Housing Benefit isn’t
being received.

 

 

 7. What is the Rate per hour Charged for each company For Support
Services for Semi- Independent Living Services (24 Hour Units) –
Information not held - the council does not pay for semi-independent
accommodation support by the hour.

mother and baby placements one in Thornton Heath which costs £1400.00
per week and one in South Croydon which costs £215.00 per week (This
is run by a charity so the placement is subsidised.)

able to calculate the missing value. This is because the Council considers
that disclosure of very low numbers of individuals would enable the
identification of a living individual from that information, or, from the
information and other data in the possession of, or likely to come into
the possession of, a data controller. Disclosure of the requested
information would result in a breach of one or more of the principles of
the GDPR/DPA 2018 and the information is therefore exempt in accordance
with Section 40(2) of the Freedom of Information Act.

format, we would need to manually check each of the 300 agencies
taking an estimated 5 minutes each = 25 hours. Section 12 of FOIA
applies.
