Dear East Devon District Council,

Context:

Under the Self-build and Custom Housebuilding Act 2015, local planning authorities are required to record data regarding self-build demand, with the ‘year-end’ fixed as the 31st of October each year.

In the interest of transparency, we would like to establish how many self-build compliant plots and permissions have been permitted in each base period to date, and how they have been deemed compliant with the Self-Build and Custom Housebuilding Act, following amendments to section 2A of the act in the Levelling Up and Regeneration Act 2023, which came into force on the 31st January 2024.

Furthermore, in a relatively recent appeal decision at Docking (King’s Lynn and West Norfolk, appeal reference 3320506, decision date October 2023) the inspector found that relying solely on CIL Part 1 forms was not sufficient to prove that permissions could be counted as self or custom build, and concluded that CIL form 2, or other evidence, would be required in addition to CIL form 1, for a permission to be counted as self build.

Acknowledging that you have already made information available in your existing and well-considered self-build monitoring reports, which cover base periods 1 - 6, our questions are as follows:

QUESTION 1 -

Please provide the number of Self-Build and/or Custom Housebuilding planning permissions and/or permissions in principle the Council has granted towards addressing demand arising from within each of the following Base Periods under Section 2A(2) of the Self-Build and Custom Housebuilding Act 2015 (as amended), together with why the permission has been allocated as self or custom build for the following periods:

-Base period 7 - from 31st October 2021 to 30th October 2022
-Base period 8 - from 30th October 2022 to 30th October 2023.
(neither of these years data seems to be published in your available reports).

Below is a list of information we are requesting for each planning permission counted within the base periods above:

-Date of consent
-Application reference including application type
-Address
-Description as per application submission
-No. dwellings proposed
-No. self/custom build units proposed
-Does the application description make reference to self or custom build? - Y/N
