Self and custom build housing provision update
Dear Stroud District Council,
Context
Under the Self-build and Custom Housebuilding Act 2015, local planning authorities are required to record data regarding self-build demand, with the ‘year-end’ fixed as the 31st of October each year.
In the interest of transparency, we would like to establish how many self-build compliant plots and permissions have been permitted in each base period to date, and how they have been deemed compliant with the Self-Build and Custom Housebuilding Act, following amendments to section 2A of the act in the Levelling Up and Regeneration Act 2023, which came into force on the 31st January 2024.
CIL self-build exemptions
If CIL forms are being used as evidence that an application meets the definition of self-build, you will note that we have included a request for both Part 1 and Part 2 CIL forms. This follows a recent appeal decision at Docking (King’s Lynn and West Norfolk, appeal reference 3320506, October 2023). In this appeal decision, the inspector found that relying solely on CIL Part 1 forms was not sufficient to prove that the site could be counted as self or custom build. CIL form 2, or other evidence, would be required in addition to CIL form 1. It is for this reason that we are also requesting whether CIL form 2 has been submitted and accepted.
With the above in mind, and acknowledging that you have previously provided information regarding permissions granted in base periods 4 - 7 in a previous request, our questions are as follows:

Please provide the number of Self-Build and/or Custom Housebuilding planning permissions and/or permissions in principle the Council has granted towards addressing demand arising from within each of the following Base Periods under Section 2A(2) of the Self-Build and Custom Housebuilding Act 2015 (as amended), together with why the permission has been allocated as self or custom build:
Base period 1 - Year ending 30 October 2016
Base period 2 - Year ending 30 October 2017
Base period 3 - Year ending 30 October 2018
Base period 8 - Year ending 30th October 2023
A list of planning permissions that have fully confirmed CIL self-build relief with the approval of form 7 part 2 signoff for ALL base periods to date.
We acknowledge that Stroud District Council CIL charging only commenced on the 1st April 2017, so will be unavailable for base period 1, and only partially for base period 2.
Below is a list of information we are requesting for each permission counted within the base periods above:

Thank you for your response. We have reassessed the original request, and
have had it independently checked by our Information Governance Officer.
We are in agreement that the wording of the original request was somewhat
unclear and that we replied appropriately given the information available.
In essence, given you asked for a range of periods, followed this with a
request for information for ‘all periods’, and mentioned information was
already provided related to periods 4-7 in a previous request, it was
assumed you meant all of the periods mentioned in your request (1,2,3,8).
We will record your request for the remaining periods: 4,5,6,7 as a new
request and will respond to it as soon as possible and within the 20
working days allowed by the legislation. We’re sorry for any inconvenience
caused, and will fulfil this request as soon as we can.
