Selection of preferred bidder for Cambridge Shire Hall

We're waiting for Paul Lythgoe to read recent responses and update the status.

Dear Cambridgeshire County Council,
I would like to make an FOI request relating to the current planned disposal sale/leasing of Cambridge Shire Hall. To that end I request the following-
1. Provision of a summary list of all parties who made a bid in any form for the purchase or leasing of Shire Hall.
2. All emails from officers or members relating to the selection process, the criteria to provide a short list of 4 preferred bidders for the full council meeting on May 14th, & where stated reasons fro preferment or rejection.
3. All minutes of meetings between officers, members & preferred bidders & in particular representatives of Brookgate the selected bidder. (Where time dissallows under FOI act then just minutes of meetings with Brookgate).
4. Minutes of meetings of officers relating to the selection of the preferred bidders & in particular, representatives of Brookgate the selected bidder.
5. All documents relating to the future plans of Brookgate for the grounds & the historic sites of Castle Mound & the Civil war eathworks.
6. The current cost of upkeep of the grounds of Shire hall & in particular castle Mound.

Re: Environmental Information Regulation ref 1088288.

 

Thank you for your email. Your request will be dealt with in line with the
Environmental Information Regulations.

 

We can confirm we hold the information you have requested, however having
reviewing the documentation held we require an extension of a further 20
working days to collate the information.

 

This extension in time is set out in Regulation 7 of the Environmental
Information Regulations 2004 which states:

 

Extension of time

7.—(1) Where a request is made under regulation 5, the public authority
may extend the period of 20 working days referred to in the provisions in
paragraph (2) to 40 working days if it reasonably believes that the
complexity and volume of the information requested means that it is
impracticable either to comply with the request within the earlier period
or to make a decision to refuse to do so.

 

This extension is required as we have identified numerous exceptions that
may apply to the information, notably Regulation 12 (5) (e) which states:

 

(5) For the purposes of paragraph (1)(a), a public authority may refuse to
disclose information to the extent that its disclosure would adversely
affect—

 

(e) the confidentiality of commercial or industrial information where such
confidentiality is provided by law to protect a legitimate economic
interest;

 

In addition, we have also identified the exception at Regulation 12 (4)
(e) may apply which states:

 

(4) For the purposes of paragraph (1)(a), a public authority may refuse to
disclose information to the extent that—

 

(e) the request involves the disclosure of internal communications

 

As a result, we consider the request to be of sufficient complexity to
require an extension of time to consider to what extent information may be
withheld under the above regulations and in particular to carry out a
public interest test under each exception to consider whether the public
interest in maintaining the exception outweighs the public interest in
disclosing the information.

 

Therefore the final deadline for this request will be 16^th July 2019.

Matt Knight left an annotation ()

The council has been in touch to say there were "errors" in the
material released on the 17th of July, and that appears to be why a
replacement response was issued on the 19th of July. We have asked the
council for details of these "errors" but they have not been
forthcoming.
