With regard to stolen vehicles, whether or not they display false registration marks, found in the possession of innocent purchasers, I ask to be provided the following information:

1. Your policy for identifying and dealing with innocent purchasers of stolen vehicles insofar as leaving such a vehicle with them is concerned and:

a. When they are seized
b. When they are left with innocent purchasers

2. When a Police Property Act hearing is instigated

3. For the past 3 years, how many such vehicles have been:

a. found
b. seized and
c. left with innocent purchasers
d. subject to a Police Property Act hearings

4. where no Police Property Act hearing is instigated, the basis upon which the vehicle, seized by your constabulary, is passed to another (not the innocent purchaser).

With regard to the time period:

calendar years; 2014, 2015, 2016 and 2017 to date

a breakdown by month is not necessary

On April 19th, 2016 the Information Commissioner in a footnote to this Decision Notice (https://ico.org.uk/media/action-weve-tak... said:

"As well as the finding above that NYP breached section 17 of the FOIA, the Commissioner wishes to note here his concern at the severity of the delay. NYP must ensure that it responds to all information requests, including those which may cover a large amount of information, within 20 working days of receipt. A separate record of the delay in this case has been made and this issue may be revisited should evidence from other cases suggest that this is necessary".

There are a significant (and increasing) number of finalisations, by NYP, on this website that have been beyond the 20 working day limit, since that notice was issued. This one is the latest.

Without knowing the context, your request would appear, on its face, to be entirely uncomplicated.

Perhaps the delay in responding to your request, in the light of the Decision Notice, is something you might wish to take up, first with NYP and then the Information Commissioner?

I have already done so within First Tier Tribunal proceedings.

I am writing to request an internal review of North Yorkshire Police's handling of my FOI request 'Seizure of Suspected Stolen Vehicles'.

You have failed to provide the malformation within the 20 days required by the Act, that s to say you are in breach of the legislation.

The issue is uncomplicated,as evidenced by other constabularies to whom I have written about the subject complying with the request.

This request should be considered in relation to information sought of your Legal Officer (Civil Disclosure)
Civil Disclosure Unit, North Yorkshire Police HQ, Alverton Court, Crosby Road, Northallerton, DL6 1BF 04/08/2017 the subject of a dismissive response yesterday which is without a NYP reference.
