Dear Hayley

Thank you for your recent request made under the Freedom of Information
Act. Please find the Combined Authority’s response below.

• What are the contractual performance KPI's for this contract?

Deliverables:

Initial considerations and highlighting areas where there may be
information gaps/specific concerns or other issues that the advisor wishes
to highlight for the benefit of the Combined Authority’s report which
encompasses all elements of the “Purpose” sections of this document. It is
envisaged that the report may be in two stages:

1. First Stage Report to feed into the Combined Authority formal decision
process (See timetable below). It is recognised that this decision may be
taken in advance of full final documentation for the project being in
place with details being delegated to Combined Authority Officers. Such
Report will therefore be on the basis of the information available. Where
there is material uncertainty or assumptions which need to be made it will
be expected that this will be included within the report.

2. Final Report at or around financial close of main funding confirming
the findings (or otherwise) of the Initial Report

• Suppliers who applied for inclusion on each framework/contract and
were successful & not successful at the PQQ & ITT stages

This was contract and not a framework. There was no PQQ. The Procurement
process was Request for Quotes with 3 bidders.

• Successful - KPMG LLP
• Unsuccessful - Deloitte LLP and Newbridge Advisors

• Actual spend on this contract/framework (and any sub lots), from the
start of the contract to the current date

9 July 2021 to 30 September 2021

• Could you please provide a copy of the service/product specification
given to all bidders for when this contract was last advertised?

The specification contains both commercially sensitive information and was
provided to applicants subject to a confidentiality agreement. The
Combined Authority must therefore give consideration to both sections 41
and 43(2) of the Freedom of Information Act. The Information Commissioner
has published guidance on both exemptions on their website at [1]this
link.

Having considered the public interest, our decision is to withhold the
information. This is because of the wider public interest in preserving
the duty of confidentiality, alongside the potential risks to commercial
interests and negotiating positions of third party organisations that
would arise from disclosure, negatively impacting on the operation of the
commercial marketplace in a manner that is contrary to the public
interest.

• Is there an extension clause in the framework(s)/contract(s) and, if
so, the duration of the extension?

There was no extension clause.

• Has a decision been made yet on whether the framework(s)/contract(s)
are being either extended or renewed?

N/A

• Who is the senior officer (outside of procurement) responsible for
this contract?

The responsible officer was Head of Investment Raphael Miller (no longer
with the organisation).
