Section 8 Conwy Harbour Revison Order

The request was refused by Conwy County Borough Council.

Dear Conwy County Borough Council,
Can you supply all recorded information on operations to Deepen, Scour, cleanse, alter and improve the bed and foreshore of the harbour. And if any materials were taken up or collected during those operations.
As stated in the Conwy Harbour Revision Order Sec 8, Power to Dredge.
I understand that agitation dredging is not dredging, so i have deliberatly left that out of the request as you have supplied that information before. Please confirm if the purpose of the agitation dredging was to deepen, scour, cleanse, alter or improve the bed or foreshore

Further to your request for information dated 27/10/2016, you are advised
that there is no additional information available on dredging than that
already advised.
 
You requested:
 
Can you supply all recorded information on operations to Deepen, Scour,
cleanse, alter and improve the bed and foreshore of the harbour. And if
any materials were taken up or collected during those operations.As stated
in the Conwy Harbour Revision Order Sec 8, Power to Dredge.
 
As with your previous request 9486-16, you are extended an invitation to
attend the Conwy Harbour Office Conwy Quay for inspection of any relevant
files – you should contact 01492 596253 to make arrangements.
 
You have been advised twice recently that consideration would be given to
assessing the purpose and value of any such future request/s on either
this topic or related topic with a view to considering whether or not S14
(FOIA) and/or Reg 12(4)(b) (EIR) is engaged.
 
I have decided that your request is vexatious and in accordance with the
S14 (FOIA) and/or Reg 12(4)(b) (EIR) the Council is not obliged to comply
with your request.
 
I will therefore not be proceeding any further with your request and
please accept this correspondence as a refusal notice under S17 and/or Reg
14.
 
Although you are at liberty to continue to make requests for information I
would advise that any future requests received in relation to the Conwy
Harbour, (or any related topics) may also be considered vexatious, or
repeated, or both.
 
I should also advise you that there is reason to believe that the name
Gavin Dalton is being used as a pseudonym, and as such requests made
through the use of a pseudonym will be considered invalid.
 
If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of this response should
be sent to [1][Conwy Council request email]
 
When you submit your request for an internal review please do so using the
email address in the paragraph above as I will be away from the office
after today for an unknown period of time, hopefully only a few days but I
cannot be sure and I would not want your request to be left unattended in
my email account until I return.

Can you please advise why you will not find the requst vexacious if i make it in person, but do find the request vexacious when made on a public forum?

Dear Mr Dalton

I am afraid I cannot accept the premise of your question. In short you cannot make an FOI request in person, it must be in writing and it is the written request that is considered vexatious given the context and history of the previous requests.

The invitation (made twice) to you to visit the Conwy Harbour offices is just that, an invitation from Conwy CBC. It is not a request in any way, shape or form from your good self.

The invitation was extended to give you an opportunity to discuss your concerns directly with those best placed to respond and/or address those concerns. I would urge you to take advantage of that opportunity.
