I have sent you a copy of the current Section 75 Partnership Agreement
between Westminster City Council and Central and North Westminster NHS
Trus by separate email as the document size exceeds the limit that this
system can handle.

 

The document has been redacted in order to obscure some information about
some posts, where it would be possible for individuals to be identified.

 

The information is exempt from disclosure under Section 40(2) of the
Freedom of Information Act (FoIA). The information is personal data as
defined by the Data Protection Act 1998 (DPA). As it is information about
someone else the release of this information would constitute a breach of
Principle 1 of the DPA. This is because disclosure would be unfair to
those people who could be identified from the information who have no
expectation that their personal data would be made public. This response
therefore acts as a refusal notice under section 17 of the FoIA. 

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to:

I am writing to request an internal review of Westminster City Council's handling of my FOI request 'Section 75 agreement with Central and North West London NHS Foundation Trust'.

In responding to my request the Council has redacted certain parts of the document claiming that the exemption in clause 40(2) of the Freedom of Information Act (personal data) is engaged.

Could I ask you to revisit those sections of the document which have been redacted to consider again whether, from the information redacted, specific individuals could be personally identified from that data.

In responding to this request for a review, please, in each case where an item is redacted, provide your reasoning for concluding that a person could be identified from that data.
