Thank you for your request dated 09/01/2024

 

Our response is as follows:

 

In response to FOI request FOI-513, the Council confirmed that they have a
contract with Residential Management Group Limited to provide Section 202
reviews of homelessness decisions. Please provide the following:

 

- A copy of the contract which Greenwich Borough Council have with
Residential Management Group Limited

 

 

- In particular, the key contractual requirements which Residential
Management Group Limited and the Council are required to comply with
during the Section 202 review process

 

We have attached a copy of our Service Level Agreement with RMG, however
the cost information under Section 4 has been withheld in accordance with
Section 43(2) for the following reasons:

 

·         Disclosure of the requested information is likely to prejudice
the Council. The disclosure of the requested information may affect the
Council’s ability to contract services at a competitive rate in the
future.

·         The requested information was provided in confidence as part of
a contractual process and to subsequently disclose the information would
affect the Council’s ability to attract future bidders.

·         If confidentiality is not upheld, then potentially attractive
and viable organisations may be deterred from entering into contracts
with the Council for fear of disclosure of their financial costings.

 

·         This is a competitive market and disclosure of information about
working practice and pricing could be used by a third party. Also, if the
requested information is disclosed, it could also be used by a competitor.

 

The exemption under section 43(2) is subject to the public interest test. 
We have considered the balance of public interest in deciding whether to
disclose the information.

 

We have considered the following factors in favour of disclosure of the
requested information:-

 

• The Council understands the importance of transparency and
accountability of its decision making.
• The Council understands the importance of ensuring fair commercial
competition in a mixed economy.
• The Council acknowledges the general public interest in being open,
transparent and accountable.

 

We have considered the following factors in favour of non- disclosure of
the requested information.

 

• It is essential that all parties who enter into a contract with
the Council are assured that their competitive advantage is not lost
for a substantial period of time thereafter as result of disclosure of
this information.
• Revealing the requested information in this market would erode their
competitive position and may impact the whole market to some degree.
• The Council may incur some reputational damage in regard to its future
contractual arrangements should the information relating to the
organisations pricing and business model be disclosed.

 

Having considered the public interest test, the balance of the public
interest favours maintaining the exemption and the requested information
is withheld in accordance with section 43(2) of the Freedom of Information
Act 2000.
