Section 172 - Road Traffic Act 1998

Your enquiry refers to the 1998 Road Traffic Act but there is not one dated that year, we have worked on the basis that you mean the 1988 Act.

Please supply the Name and Rank of all personnel currently authorised by the Chief Constable of Essex Police, to demand information, particularly the name of a driver, from the registered keeper of a vehicle under the above Act.


The Dates of the authority having being given.

Essex Police policy p51/04, dated 16/2/2004, allows that officers of all ranks (currently Essex Police has 3654 Officers) to sign the form requesting information 'on behalf of Essex Police'. An extract of that policy follows for information and I hope it answers your enquiry.

APPLICATION FOR NAME AND ADDRESS OF DRIVER - FORM A150

The application for name and address of driver Form A150 under Section 172 of the Road Traffic Act 1988 (as amended) has been revised. The new format allows all ranks to sign the form 'on behalf of Essex Police', rather than by a Superintendent as previously shown.

Part 'B' of the form now gives the respondent an opportunity to supply the e-mail address and/or telephone number for contact of the nominated driver if they so wish.
