Section 154 Notices

For the years 2021, 2022, and year to date 2023
By area for example, Eden, South Lakeland etc. (or in what ever areas the Council records this information)

Environmental Information Regulations 2004 Reference: FOI-95485-2023

Thank you for your request for information regarding Section 154 Notices,
which was received on 28/02/2023.

The council aims to provide you with the information within the statutory
timescale of 20 working days in this case the date is 28/03/2023.
Subject to the information not being exempt or containing any references
to third parties.

The council will, as a matter of routine make information available in
electronic format. Where it is not practical to do this information will
be provided in hard copy (paper). If information is required in
alternative formats e.g. language, audio, large print, etc., please
indicate this as soon as possible so the council can consider your
request.

The Environmental Information Regulations 2004 define a number of
exemptions/exceptions which may prevent information being released to you
automatically. The council will make an assessment about the application
of any exemptions/exceptions and issue you with a decision letter, which
will include details of your right to appeal.

If the information you request contains reference to a third party the
council will consult with them prior to making a decision about the
release of information.

In accordance with the council's Charging Policy a fee may be charged for
supplying information. If a fee is payable you will be issued with a fees
notice. The applicable fee must be paid in full before the information is
processed and released. The statutory time limit for responses is
suspended until the council has received and processed your payment. If
payment is not received within three months of issuing the fees notice
your request will be closed.

Good Afternoon John

Thank you for your email and I am sorry that you are still waiting for our response.

I have received all but 1 figure for 2021 for each year across all the area network managers, so it has taken some time to collect the information, and it will need to go to a senior manager for approval (as you can appreciate things are being delayed slightly due to Local Government Reform) I am still confident though you will have the information returned to you before Friday, 31st March 2023.

Again apologies for the delay and thank you for your patience.

Thank you for the response dated 30th March 2023
Whilst the information provided goes some way to answering the request clearly a significant part is absent.
The Council will have the postcodes for the area of each S154 Notice as they are issued by the Council team.
This would enable each Council within the County to be identified.

Please will you provide the first 3 digits of the post code for each S154 notice.
This is not an onerous task as there is 60 notices issued within the 3 year time frame.

Dear John,

Thank you for your email of 18th April 2023 following our response to FOI request 95485.

It is my understanding that the information was requested for "in whatever areas the Council records this information."

I requested this information from the local area network managers, who record this information in number format by year, when a 154 notice has been issued by legal services.

I have spoken to the network managers following your email, and they do not record this information in any other way, i.e. postcodes as the letters go out via legal services.

It is also my understanding that this information may be held within legal services, but again they have confirmed to me, it is not recorded by them in such a way as would make this an easy task.

It might take some time for them to collate this for you (the information may be held in emails/ inside folders etc).

Further to this, I am wondering if specifically requesting, "the postcodes for the area of each S154 Notice as they are issued by the Council team," forms part of a new request and should be submitted as such, as we have responded with the information as it was recorded at the time of the request?
