Question: Please advise me how much monies your Council is currently holding under
Section 106 agreements entered into with applicants under the Town &
Country Planning Act, 1990 as amended? I would be grateful if you would also provide the
figures for financial years 2012/13, 2011/12 and 2010/11?
We have divided the response into:
a) On site open space maintenance and provision = PLANNING AND PUBLIC
PROTECTION
b) Commuted sum in lieu of affordable housing = HOUSING
c) Off site maintenance and provision = HOUSING AND COMMUNITY DEVELOPMENT
d) The Prestatyn Community Fund = ECONOMIC REGENERATION
Answer a): On site open space maintenance and provision. Response provided by the
Planning and Public Protection Service
Planning and Public Protection only hold certain pots of money. We can tell people what
came in and when, and what for. However, currently once it leaves us, Planning cannot tell
anyone how much they have left in their accounts. We believe this is what is meant by
holding in regard to monies collected via a S106.
The year end balances for onsite open space maintenance and provision is shown below.

Answer d) The Prestatyn Community Fund = ECONOMIC REGENERATION
The applicant provided £75,000 to establish the Prestatyn Community Fund in 2012/13.
£10,604 has been spent during 2013/14 leaving a balance of £64,396.
