Thank you for your e-mail dated 5^th September 2011 received in our office
on 5^th September 2011, concerning the system for the expenditure of S.106
money.

I enclose for your attention, the following information.

Question 1. When was the system changed after September 2010?

Answer 1. The process by which schemes requesting the use of S106 funding
were approved was detailed in a report to Cabinet dated 9th September 2009
at paragraphs 3.6 to 3.8 and is attached with the relevant appendix. There
has been no subsequent change to the process.

Question 2. Who in cabinet presented the report to change the system and
why?

Answer 2. The report was a joint report of the Cabinet Member for Finance
and Benefits and the Director of Finance. The process for approval was
changed in order to bring approval for capital schemes funded through S106
monies into alignment with the approval process for all other capital
schemes and ensure greater transparency and a better audit trail.

Question 3. What is the new system for the expenditure of S.106?

Answer 3. All approvals for S106 funded schemes must be through Cabinet in
a similar manner to all other new capital schemes.

Question 4. Has this change been presented to Full Council or, if not,
when is it going to be presented?

Answer 4. All Cabinet reports are circulated to all Members five days
before each cabinet meeting. All Cabinet decisions, other than those
which have to be confirmed by Council, are reviewed by a Scrutiny
Committee which has the power to defer or refer back decisions. The
Cabinet decision made on 9th September 2009 was reviewed by Scrutiny
Committee on 14th September 2009, which endorsed the decision. Scrutiny
Committee consists entirely of non-Cabinet members.

Cabinet and Scrutiny minutes are also presented to Full Council where they
can be challenged and, if Council passes a resolution, referred back. The
Full Council met on 24th September 2009 and noted the minutes.
