Secret Directive from HOBTPCT to GPs prohibiting dealing honestly with "dental problems" (in reality mercury poisoning)

Dear Heart of Birmingham Teaching Primary Care Trust (PCT),

I have been trying (with bizarre unsuccess) for some years to get proper diagnosis and treatment of the severe disabilities clearly caused by dental amalgams. There has been a vast amount of pseudo-science and other outrageous nonsense issuing from NHS personnel before the following incidents.

On 10th November 2010, GP Dr Peter Gini stated in a letter that "This is a dental problem.....Unfortunately we cannot take this any further".

On 11th November, Dr Gini said orally to me that he was prevented from dealing with such "dental problems" by some directive issued by HOBTPCT. And so I would have to contact HOBTPCT PALS about it.

On 15th November an email from the PALS of HOBTPCT stated:
"I can trace no directive from this PCT regarding the issue that you raise."
The same day I enquired by letter to Dr Gini to clarify quite what was the directive to which he had referred. Five weeks later there has still been no reply.

Please provide the following information.
1/ What is the content of this secret directive.
2/ Who was it issued by, and when.
3/ For what purpose and on what rationale was it issued.
4/ Why is it secret?
5/ When are the NHS/DoH going to do anything decent about the massive illness they have caused (and continue to cause) with dental amalgams, and stop pretending that fraudulent reports such as SCENIHR are honest proof of safety?

Dear HoBtPCT Freedom Of Information,

Thank you for your prompt reply. You refer to the BMA guidance document "Patients presenting with dental problems: GP responsibilities, 15 October 2007", but that is concerned only with "emergency dental treatment" and has no relevance to my clearly chronic condition. So there remains the unanswered question of quite what document (if any) it was that Dr Gini said prevented him from doing anything about a so-called "dental problem" (namely mercury poisoning).

So could you please clarify whether there is in fact no such document constraining Dr Gini, from any valid source (such as Secretary of State) or whether your information capabilities are not sufficiently comprehensive to give that answer in full.

And if there is no such document, then why did Dr Gini write that he could not deal with this "dental problem" and then told me that there was indeed some communication from the PCT, of whom I would need to enquire about it?

Heart of Birmingham tPCT is not aware of any secret directive or any other documentation to which you refer to within your request. The trust believes that the GP may have been referring to the BMA guidance which was previously attached in the original response.

Regarding the later part of your request, why did the GP state he could not deal with your dental problems if there is no such document, this falls under the trusts complaints procedure. For the trust to responded to this we would require the complaints team to investigate into this matter and as such this part of your request does not fall under the element of the FOI Act.

If you wish to proceed with this element of your request I advise you to submit this to the complaints department in writing to: Complaints Manager, Heart of Birmingham Teaching PCT, 142 Hagley Road, Birmingham, B16 9PA.

Dr Gini has now sent me a copy of the document - a letter from the BENPCT Dental Services, which relates to patients consulting GPs about "dental problems". It is clear it is nothing to do with my own case of non-dental problems caused by the mercury from the dental amalgams. So Dr Gini was in error in citing that document. Meanwhile he has prematurely declined, without good reason, to continue with any further proceeding with the diagnosis or treatment of my serious chronic mercury poisoning.
