I am writing to formally request information under the Freedom of Information Act 2000 regarding the consideration of secondary school cases under Priority 2 (Compelling medical or other exceptional reasons) in Brighton and Hove for the past three academic years. Specifically, I would like to request the following:

(1) Number of Cases Considered: The total number of secondary school cases that were considered under Priority 2 for each school in Brighton and Hove during the past three academic years (from September 2022 to September 2024).

(2) Breakdown by School: A breakdown of the number of Priority 2 cases considered for each individual school in Brighton and Hove, for each of the past three academic years.

(3) Reasons for Decline: A breakdown of the reasons for any Priority 2 cases that were declined, for each school and each of the past three academic years. This should include specific reasons given for the decision to decline each case.

Please provide this information electronically where possible. If any of the requested information is withheld under an exemption, I kindly request a detailed explanation of the exemption applied and, where applicable, the public interest test reasoning.

I am writing to formally request an internal review of the Council’s response to my FOI request regarding the consideration of secondary school cases under Priority 2 (Compelling medical or other exceptional reasons) in Brighton and Hove for the past three academic years (reference number 17761258)

This is on the basis that in the response I received, data was provided for 2022 and 2024, but no records were retained for 2023, aside from confirmation that four applications were granted priority. Specifically, I was informed that:

"No details of the number of requests considered have been retained"
"No meeting minutes or details of the requests considered have been retained"

Given the nature of this information, I would like the internal review to consider:

(1) Whether the Council’s data retention policies have been adhered to in this case, particularly regarding the absence of any records for 2023.
(2) Whether the failure to retain this data is compliant with the Council’s broader GDPR obligations, including principles of accountability and transparency.
(3) A full explanation as to why the requested data for 2023 is not available and how this aligns with the Council’s internal policies and legal requirements.
(4) A reconsideration of my original request, including whether any further relevant information can now be provided.

Dear Brighton and Hove City Council,

I am writing in relation to your recent internal review response concerning my Freedom of Information request regarding secondary school admissions under Priority 2.

I note with concern that your response contains a clear inconsistency: it opens by stating that the Council does not uphold my complaint, yet concludes that the internal review has been partially upheld. I would be grateful if you could clarify this contradiction and confirm which elements of the original handling of the FOI request were deemed appropriate, and which were found to be flawed or have since been remedied.

In addition, I remain extremely concerned by the acknowledgement that relevant information was deleted prior to responding to my request. I would appreciate clarification on the following:

- Was this deletion the result of human error by a single individual, or was it reflective of a broader systemic issue?

- Were there any checks and balances in place that should have prevented the deletion of relevant information, particularly given the Council’s obligations under the Freedom of Information Act?

- Does this incident indicate a failure to follow the Council’s own data retention and FOI handling procedures?

- If relevant policies and procedures were in place, please clarify how this error was allowed to occur despite those safeguards.

This is now one of several recent instances where internal reviews have highlighted that information was withheld or not disclosed in full, raising wider concerns about the Council’s compliance with its statutory obligations, and its overall approach to transparency and accountability.

Unless a clear and satisfactory explanation is provided within 10 working days, I will have no option but to escalate this matter to the Information Commissioner’s Office (ICO) for formal investigation.

I am writing to request an internal review of the Council’s decision to refuse this FOI request under Section 14(1) of the Freedom of Information Act 2000.

I respectfully ask the Council to reconsider its application of Section 14(1) in this case. As I have set out in detail in my recent internal review submissions for FOI Ref: 18085602, FOI Ref: 18357837, and FOI Ref: 18225049, I strongly contest the assertion that my requests are vexatious. My conduct has been reasonable and respectful throughout, and each request has been submitted in good faith, with a clear rationale and public interest purpose.

This request is either clearly distinct or a proportionate follow-up to previous responses and does not meet the statutory threshold for refusal under Section 14(1).

Please confirm receipt of this internal review request and advise when I may expect a full response.
