Dear Norfolk Fire and Rescue Service,

The following information relating to Norfolk Fire and Rescue Service is requested in accordance with the Freedom of Information Act (FOIA) 2000.

1. Are staff working for Norfolk Fire and Rescue Service (NFRS) permitted to undertake work other than with NFRS as secondary employment?

2. Please provide a copy of the NFRS secondary employment policy.

3. Where staff that are employed by NFRS wish to undertake services on behalf of Norfolk Safety CIC, is approval for secondary employment required from Norfolk Fire and Rescue Service using the same policy as other outside employment?

4. If a different secondary employment policy to the policy referred to in 2 above is applied for NFRS staff who wish to provide services on behalf of Norfolk Safety CIC, please provide a copy of the policy?

5. Are uniformed staff who are approved to undertake secondary employment allowed to wear NFRS supplied uniform and personal protective equipment when undertaking secondary employment (including delivering services on behalf of Norfolk Safety CIC)?

6. Does NFRS/Norfolk County Council pay the employer costs (including salary, NI, pension contributions) when a member of staff undertakes secondary employment working for Norfolk Safety CIC?

7. What proportion of the costs identified in 6 above were recovered by NFRS from Norfolk Safety CIC for the financial years 2018-19 and 2019-20?

8. What financial payments were received by Norfolk County Council from Norfolk Safety CIC for the financial years 2018-19 and 2019-20 in respect of:
- use of Norfolk County Council premises
- use of Norfolk County Council equipment

9. When were matters relating to State Aid Rules and distorting competition as set out in the Chief Fire Officers Association (CFOA) report regarding FRS uniform and logos and the contents of the Grant Thornton LLP report on fire trading companies, reported to the Fire and Rescue Authority in relation to Norfolk Safety CIC? Please provide a copy of the report to Members.

I refer to your request for information dated 11 December 2019.

 

You asked for:

 

 1. Are staff working for Norfolk Fire and Rescue Service (NFRS) permitted
to undertake work other than with  NFRS as secondary employment?

 

Our response:          

 

Some staff are permitted to undertake secondary employment.

 

Depending on the type of role held, some staff are required to gain the
express consent of the County Council before undertaking any outside work
or additional appointments. If this requirement to seek consent applies to
the employee, it will be shown in their Statement of Particulars or in the
Conditions of Service.

 

Whole-time firefighters working for Norfolk Fire and Rescue Service are
not permitted to undertake secondary employment without first seeking
consent.

 

 

 2. Please provide a copy of the NFRS secondary employment policy.

 

Our response:

 

A copy of the Secondary Employment Procedure for Wholetime firefighters is
attached. There is no specific secondary employment policy for other
NFRS/NCC staff.

 

 

 3. Where staff that are employed by NFRS wish to undertake services on
behalf of Norfolk Safety CIC, is approval for secondary employment
required from Norfolk Fire and Rescue Service using the same policy as
other outside employment?

 

Our response:

 

The policies and arrangements set out in the responses at Q1 and 2 above
apply.

 

 

 4. If a different secondary employment policy to the policy referred to
in 2 above is applied for NFRS staff who wish to provide services on
behalf of Norfolk Safety CIC, please provide a copy of the policy?

Our response:

 

The full costs of any NFRS staff working for the Norfolk Safety CIC are
funded by the CIC, including salary, NI and pension contributions.

 

 

 7. What proportion of the costs identified in 6 above were recovered by
NFRS from Norfolk Safety CIC for the financial years 2018-19 and
2019-20?

 

Our response:

8. What financial payments were received by Norfolk County Council from
Norfolk Safety CIC for the financial years 2018-19 and 2019-20 in respect
of:

- use of Norfolk County Council premises

- use of Norfolk County Council equipment

 

Our response:

 

2018-19         £10,000

2019-20         £0 (however, a payment will be due before the end of
2019/20)

Our response:

 

The Fire and Rescue Authority function for the Norfolk Fire and Rescue
Service is carried out by the County Council’s Cabinet. No reports have
been presented to the Cabinet on either of these two documents.

 

On a day to day basis, the functions of the Fire and Rescue Authority are
delegated to the Cabinet Member for Communities and Partnerships. The
Cabinet Member has been provided with a hard copy of the Grant Thornton
LLP report and had the opportunity to discuss this with both the Chief
Fire Officer and the Managing Director of Norfolk Safety CIC.
