Dear Sunderland City Council,

Could you ask the City Solicitor to clarify whether there are any covenants or legal restrictions preventing the development of Council-owned land at Seaburn in Sunderland.

This is a general request applying to all land and property held by Sunderland Council in the area with specific reference to two sites; the Seaburn Showground (in front of the Marriott Hotel) and the land just beyond Morrison's supermarket which I also understand to be owned by Sunderland City Council.

I refer to your Freedom of Information request dated 20th July 2012 at
13.55 hours seeking clarification as to whether there are any covenants
or legal restrictions preventing the development of Council-owned land
at Seaburn in Sunderland.

The Council's land ownership including that at Seaburn is registered
with the Land Registry. The information held by the Land Registry will
be the most up to date title information for the parcels of land in
which you are interested and can be easily accessed by you. This
information will identify any covenants or legal restrictions which
effect the land that you are interested in. By way of information and
for ease of reference the Land Registry title numbers which appear,
based on the limited information provided, to be relevant to your query
are TY472368 and TY471508. Information can be obtained from the Land

Pursuant to section 21 (1) of the Freedom of Information Act 2000
information which is easily accessible by you, even though it may only
be accessed on payment, is exempt information and your request is
accordingly refused on that ground.
