Freedom of Information, Highland Council

Dear Mr Ross ,

Request for information under the Freedom of Information (Scotland) Act
2002

With regard to your request for information concerning the Scottish
Independence referendum.  We have referenced your response as 980113,
please quote this in further correspondence relating to this matter.

You requested a breakdown of the Scottish Referendum Count results showing
the number of yes no and spoiled ballot papers. In Highland, a total of
78,069 votes were cast for Yes and a total of 87,739 votes were cast for
No.

A total of 168 votes were rejected, including:

0 (zero) did not bear the official mark on the ballot paper;
30 voted in favour of both answers;
0 (zero) included writing or a mark by which the voter could be identified
and 138 were unmarked or void for uncertainty.

You asked for a list of which polling station votes where mixed with each
other. This information is not available to the public.  You also asked
for a separate breakdown of the yes no and spoiled ballot papers from each
separate "sub count. Again, this information is not available to the
public.

Please note that information held by the Counting Officer is not covered
by the Freedom of Information (Scotland) Act 2002.

(EIRs), you have the right to request that the Highland Council reviews
any aspect of how it has dealt with your request. This requirement for
review should be put in writing to the Freedom of Information Officer,
Chief Executive’s Office, Glenurquhart Road, Inverness IV3 5NX, within 40
working days of receipt of this letter. The request should include details
of the information requested and the aspects of the Highland Council’s
response which you are not satisfied with.

If you are subsequently dissatisfied with the outcome of the Council's
review, you have the right to appeal to the Scottish Information
Commissioner under Section 47 of the Act (Regulation 17 of the EIRS),
within six months of receiving the Council's review response.

Further guidance on information request reviews and right to appeal can be
