The request was refused by Crown Office and Procurator Fiscal (Scotland).

Please could you send me a copy of what the Magic Circle Affair Report calls the Orr Report

Yours faithfully,

Dear Crown Office and Procurator Fiscal (Scotland),

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Crown Office and Procurator Fiscal (Scotland)'s handling of my FOI request 'Scottish Crown Office Circular'.

In response to my email of 10th Feb I received this response on the 11 February 2014 BUT to the request that I withdrew headed Crown Office Directives 2025, 2025/1. This was withdrawn as you seemed to be having trouble with the fact that I called them circulars and you were claiming that you needed clarification.

"Dear Ms Nickson
Thank you for your email of 10 February 2014.
We have a record of a freedom of information request from you made on 7 November 2013. We sent you a number of emails seeking clarification on this matter, following which our records indicate that you withdrew the request. I attach your email for your ease of reference.
Kind Regards
FOI Enquiries
Crown Office"

However I replaced that with another email later the same day entitled "Scottish Crown Office Circular" the 13 December of which this is a copy, so that you could have pretext for not being able to find the information.

13 December 2013

Dear Crown Office and Procurator Fiscal (Scotland),

Please therefore carry out an internal review into the time delay, and please do not delay in providing the information I requested, without waiting for the internal review

Dear Ms Nickson

Thank you for your e-mail dated 11 February. I regret that your e-mail dated 13 December was not picked up as a new request at the time. We are now attending to this matter and your request for review and aim to provide you with a full response by 13 March."

With regard to the subject matter, I do remember this - but I think I was on maternity leave at the time and therefore not directly involved in the Private Office. There was a secure cabinet in the basement which contained the papers - but I'm pretty sure they have been destroyed now. I wonder if Scottish Govt might hold anything?

Library, Private Office and Crown Agent's office are the best hopes for finding anything on this.

Dear FOI Enquiries,

Thank you for your reply Carol and some information on the subject matter
I am unsure if you are looking for this information or whether that was my response.
Does the Crown Office hold the information?
You mention the Library, Private Office and Crown Agent's office, are they separate bodies for FOI requests, or are they connected to the Crown Office and you contacting these for me? If they are separate bodies for FOI could you send me their email contact.

The original amended request was started on 13th December.

Yours sincerely,

Angie Nickson

Dear FOI Enquiries,

I am grateful for your reply.

I accept for now the premise that the FOI Act gives a right to information not documents.

However the complete information is not present in the copy of the Nimmo Smith Report.

I would therefore ask for a copy of all the information on the Circulars.

Further I would ask if there is any reason why the Crown Office does not wish to provide the Circulars themselves, particularly as the precise wording of the circulars is of the essence in this case?

Yours sincerely,

Angie Nickson

Dear FOI Enquiries,

I am not asking for an internal review. I am asking for advice and assistance under Section 15
However please state exactly in the law or ICO guidance which states that there may not be an internal review on timeliness and then one on the substantive request?

I may have missed it but cannot see where you have answered whether you have copies of the circulars?

Further I would ask if there is any reason why the Crown Office does not provide the Circulars themselves, particularly as the precise wording of the circulars is of the essence in this case?
