Fail - Pointless making request in same format as William, we already know from their response of December 15 that this exceeds the cost/time limit.

Should have made as four separate requests, as they originally agreed to process for him in that format.

Probably would also have been a good idea to actually state what specific information you wanted - FOI is not a general right to documents, its a right to information.

Thank you for your recent email. I have now had a chance to look at the
request that you have made in more detail. I see that you are aware of how
we have dealt with a request of a similar nature and expect that it will
not be a surprise for you to hear that we will be unable to fulfil the
request as it stands.

 

Section 12 of the Act makes provision for public authorities to refuse
requests for information where the cost of dealing with them would exceed
the appropriate limit, which for central government is set at **600. This
represents the estimated cost of one person spending 3.5 working days in
determining whether the Commission holds the information and then
locating, retrieving and extracting the information.

 

I estimate that it will take us in excess of 3.5 working days to determine
appropriate material and locate, retrieve and extract the information in
reference to your request.

 

We will, though, be prepared to service the request by dealing with it as
4 separate requests relating to each charity individually. I must also
stress that the Act provides the right to information rather than just
general copies of correspondence. With this in mind I think it would be
useful if you could help us by being more specific about what information
you particularly wish to obtain, including any dates or period of time
relevant to the information required. 

 

I look forward to receiving your response and confirmation that this
approach will be acceptable to you. I apologise again for the considerable
delay that you have encountered in respect of this request and will aim to
resolve the matter as swiftly as possible on receipt of your response.

at the
request that you have made in more detail. I see that you are
aware of how
we have dealt with a request of a similar nature and expect that
it will
not be a surprise for you to hear that we will be unable to fulfil

Section 12 of the Act makes provision for public authorities to
refuse
requests for information where the cost of dealing with them would
exceed
the appropriate limit, which for central government is set at
**600. This
represents the estimated cost of one person spending 3.5 working
days in
determining whether the Commission holds the information and then
locating, retrieving and extracting the information.

 

I estimate that it will take us in excess of 3.5 working days to

reference to your request.

 

We will, though, be prepared to service the request by dealing
with it as
4 separate requests relating to each charity individually. I must
also
stress that the Act provides the right to information rather than
just
general copies of correspondence. With this in mind I think it
would be
useful if you could help us by being more specific about what
information
you particularly wish to obtain, including any dates or period of
time
relevant to the information required. 

 

I look forward to receiving your response and confirmation that
this
approach will be acceptable to you. I apologise again for the
considerable

Anastasis - I'm confused, your request for copies of all documents/notes/records relating to the charitable status of these four charities doesn't seem to actually request any specific information?

Unless you and William are just asking the authority to make/supply copies of everything just for the 'fun' of it, maybe you should think about constructively refining your requests like the authority have asked?

FOIA doesn't give a general right to receive copies of everything, it gives a right to access information held by authorities (although sometimes supplying documents containing requested information can be easier and more helpful than providing summaries of content).

This is just my opinion, definitely not that of the whatdotheyknow website or its volunteer administrators.

Still - there is I think a real risk that, unless your requests are refined/clarified, these will damage the 'credibility' of all those other serious requests you and William have made through the site.

The site has policy on 'vexatious' requests and it really seems that you and William are kind of moving into that area, unless you can respond/clarify as the authority have asked.

Realistically - no organisations applying or corresponding with an authority are going to include anything that says 'we aren't really charities, oh! and we have a hidden agenda to take over the world for the secret masters from space'. Be kind of defeating the purpose and just plain silly.

The authority here could (it seems to me)justifiably reply simply by confirming that the applications submitted by these organisations met the critera to be registered under UK law - and leave it at that - their charitable status is already in the public domain and so are their published accounts/governing documents - exactly what other information on their charitable status are you and William requesting?

Scientology, Common Purpose, and all the other nutty consipiracy theories associated with 'plots to take over the world' aren't serious subjects for FOI and may be best reserved for the many 'I believe' blog sites out there in cyberspace.

Anastasia - Setting aside the 'open' nature of the requests made by yourself and William, after some careful thought and discussion it is clear that the authority here has significantly failed to provide a genuinely substantial response - or to follow through on the results of the internal reviews already conducted on the original request.

For that reason, if no meaningful response is sent to William by this weekend, I will be submitting a separate request myself throught this site - using a different approach I think likely to encourage a response.

I think you will find it makes for interesting reading.

Allowing for the public holidays, we will have to wait until January before there is any real movement.
