1. A list of all schools in the borough that serve meat from animals that were not stunned before they were slaughtered ('non-stunned meat').

2. A list of all schools in the borough that serve non-stunned meat only, with no alternative choice of meat.

3. The council's justification for refusing to provide this information in response to previous enquiries, particularly enquiries from local newspapers. (These enquiries should have been processed in the same way as this enquiry under the Freedom of Information Act.)

As the council has apparently gathered but repeatedly refused to provide this information in response to media enquiries I expect you to be able to fulfil this request in good time for public analysis, in other words at least one week prior to the next full council meeting on 12th December.

Regulation 6(1)(b) of the Environmental Information Regulations 2004,
applies to this information and therefore the Council is not under an
obligation to provide additional copies.

 

For information, Regulation 6 of the Environmental Information Regulations
2004 states:

 

6.—(1) Where an applicant requests that the information be made available
in a particular form or format, a public authority shall make it so
available, unless—

(a)it is reasonable for it to make the information available in another
form or format; or

(b)the information is already publicly available and easily accessible to
the applicant in another form or format.

(2) If the information is not made available in the form or format
requested, the public authority shall—

(a)explain the reason for its decision as soon as possible and no later
than 20 working days after the date of receipt of the request for the
information;

(b)provide the explanation in writing if the applicant so requests; and

(c)inform the applicant of the provisions of regulation 11 and of the
enforcement and appeal provisions of the Act applied by regulation 18.

 

If you are not content with the handling of your request, you have the
right to ask for an internal review.  Requests for internal reviews should
be submitted within 40 working days of the date of receipt of the response
to your original request and should be addressed to the Monitoring

Dear Kirklees Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Kirklees Borough Council's handling of my FOI request 'Schools serving non-stunned meat'.

The response giving links to school menus is not adequate. The menus provided at these links do not mention whether meat is from animals that were stunned before slaughter or not. Most halal meat sold to the general public is from animals that were stunned before slaughter.

The Environmental Information Regulations 2004 do not apply to this information request, because the information requested is not environmental information as defined by those regulations.

Section 11 of the Freedom of Information Act 2000 requires you to provide the information in the form that I have requested 'as far as is reasonably practicable' i.e. in this case summary lists of schools.

Please provide the information that I have requested in the form that I have requested without further unnecessary delay.
