Freedom of information

 

We have dealt with your request in accordance with the Freedom of
Information (FOI) Act 2000.

 

The first requirement of the Act is that we should confirm whether or not
we hold information of the description set out in your request. I can
confirm that our database does hold information on the date of most recent
inspection for all maintained primary and secondary schools. 

 

It is possible to obtain the data requested as of the 31^st December via
the Ofsted website.

o In the available downloads section the first file is “[2]Maintained
schools inspections and outcomes - Oct to Dec 2012 (Provisional).zip”
o Within this zip file you need the file
“06_1303_Most_Recent_31_Dec_2012_(Provisional).xls”.  This contains
the most recent judgements of all schools where the inspection was
carried out prior to the end of December and had been published by the
end of January.
o Within this file you can find those primary and secondary schools that
have not been inspected in the last 4 years by filtering on:

 1. Column I: Phase = Primary or Secondary
 2. Column L: Inspection end date <= 31^st December 2008

o This shows the 2589 primary and secondary schools that have not been
inspected since 31^st December 2008

 

Section 21 of the FOI Act provides that we are not obliged to further
disclose this information or to present it in an alternative way.

We are unable to include school inspections from 1 January 2013 onwards as
they are currently under embargo. This data is exempt from release under
section 22 of the FOI Act – Information intended for future publication.
Section 22 states:

 

(1) Information is exempt information if

(a) the information is held by the public authority with a view to its
publication, by the authority or any other person, at some future date
(whether determined or not),

(b) the information was already held with a view to such publication at
the time when the request for information was made, and

(c) it is reasonable in all the circumstances that the information should
be withheld from disclosure until the date referred to in paragraph (a).

 

Ofsted considers that all three of the above conditions apply, therefore
the exemption is engaged.

 

The Balance of the Public Interest 

 

Section 22 of the Act is a qualified exemption. When a qualified exemption
applies to information we are required to address the ‘public interest
test’.

 

Ofsted has yet to fully assemble and analyse a list of inspections from 1
January onwards. There is some public interest in being provided ‘live’
lists of inspection outcomes, as they occur. However, this is
counterbalanced by the fact that all inspection outcomes are already
published on the Ofsted website in the form of individual reports. The
fully assembled and analysed list of inspections for the period from 1
January 2013 onwards will be published at a later date.

 

Ofsted has a clear duty to ensure that all the statistical information
placed in the public domain is accurate. In this case the data that are
currently held have not been checked for errors (our validation process).
Only when all these quality assurance and validation checks have been
completed should such data be published. It is clearly in the public
interest for Ofsted’s publications to undergo these necessary checks. We
are therefore not releasing the data to you prior to publication.
