School dinner increase
Dear Middlesbrough Council,
At the meeting of the full council on 5th September the Mayor stated that a school meal price increase would not come into force due to the council failure to consult.
I would like to know:
1. The date the Monitoring Officer became aware of the potential unlawful application of the price increase;
2. Who made the Monitoring Officer aware of the potential unlawful application of the price increase, and;
3. A copy of any correspondence received by the Monitoring Officer alerting him to the potential unlawful application of the price increase.
These aren’t onerous requests and can be redacted where necessary.

Response: The Monitoring Officer, having previously considered a call-in
request which was a nullity, became aware on 3 September 2018 of the
potentially unlawful nature of the proposed price increase following the
publication and dissemination of the Judgement in R (on the application of
KE, IE, and CH) v Bristol City Council in late August;
2. Who made the Monitoring Officer aware of the potential unlawful
application of the price increase, and;
Response: The Monitoring Officer formed that judgement personally, in
light of the above case; and
3. A copy of any correspondence received by the Monitoring Officer
alerting him to the potential unlawful application of the price increase.
Response: No correspondence alerted the Monitoring Officer to the
potentially unlawful nature of the proposed price increase.

I refer to your email received on 14th December 2018, in relation to the response you received to your request for information ref: 013690. I can now provide you with the following information in relation to your further query.
Query - For completeness please can you provide me with the date of the call-in to which you refer and who that call-in was submitted by.
Response: The putative call-in request was submitted on 17 August 2018 by the MICA group at Middlesbrough Council, the lead signatory being Councillor Brian Hubbard; however, due to the null nature of the officer decision (for reasons previously explained), the call-in was also a nullity.
