Dear Ms Leett

Further to your Freedom of Information Request regarding the cost of
agency spend in schools, firstly, may I apologise for the length of time
it has taken to respond to your request. This is due to an oversight on
my part.

Please find attached information which relates to payments made by the
Local Authority only. Some Secondary and Primary Schools also have
their own bank accounts, therefore to have an accurate record of such
costs you will need to contact the governing bodies of the schools
directly who are, as you may be aware, separate public bodies for the
purposes of the Freedom of Information Act 2000 (the Act). The second
attachment provides you with a list of schools that you will need to
contact.

With regard to the spend with each Agency, we feel that this is exempt
information under Section 43 of the Act which deals with prejudice to
commercial interests. This is a qualified exemption and we have
therefore applied the public interest test. In making this decision we
have weighed such factors as the Council's desire to be open and
transparent in all its dealings against the need to ensure that it is
able to contract openly in the market.

Accordingly, insofar as this element of your request is concerned and in
accordance with Section 17 of the Act this e-mail acts as a Refusal
Notice to this part of your request.

As you may be aware you have a right of appeal against this decision. If
you wish to exercise this right please set out in writing your grounds
and send your appeal to the Council's Corporate Feedback Coordinator.
