Schedule 1 Committee

Department for Communities (Northern Ireland) did not have the information requested.

Dear Department for Communities (Northern Ireland),

The Charity Commission NI purported to convene for the first time, a committee convened to schedule 1 CANI 2008 on the 3rd June 2019.

However, the minutes of the board meeting of that body (CCNI) dated 27th June 2019, refer to minutes of meetings of this committee dated the 22nd May 2019 and "not to publish the minutes from the Schedule 1 Committee and to an amendment to the Terms of Reference...….. proposed by Gerard McCurdy and seconded by Kieran Donaghy".

Section 9 (4) of CANI 2008 states: "in performing its functions the Commission must, so far as relevant, have regard to the principles of best regulatory practice (including the principles under which regulatory activities should be proportionate, accountable, consistent, transparent and targeted only at cases in which action is needed".

Given the heightened public interest (and the recent High Court judgement) in how the regulator takes statutory decisions, and as the oversight body responsible, please publish the minutes as recorded, or otherwise state how a decision not to publish is in the public interest.

I am writing to request an internal review of Department for Communities (Northern Ireland)'s handling of my FOI request 'Schedule 1 Committee'.

Your answer states "I wish to advise you that following a search of our paper and electronic records, I have established that the information you requested is not held by this Department. You may wish to contact CCNI directly as they may have the information you require."

I confirm that a response from CCNI is due by the 16th February 2019.
In the event that request is unsuccessful, I would ask the DFC to "look again". It appears that if the department where not to be in possession of those minutes as requested, that a note of concern would need to be made to the Head of the Civil Service, this omission by CCNI being a matter of public interest.
