Further to your request for information under the Freedom of Information
(Scotland) Act 2002 relating to the above I am now able to respond.

 

I now have pleasure in attching a copy of the Contract for your use. 
However, we have taken out the Pricing Schedule information as this is
commercially sensitive information under Section 33(1)(b) of FOISA.

 

I hope you are happy with the information provided but have to advise that
you have a right to request a review within 40 working days of receipt of
this email.  You should either e-mail [1][Scottish Borders Council request email] or write
to the Data Compliance Officer, Scottish Borders Council, Council HQ,
Newtown St.Boswells TD6 0SA.

I am writing to request an internal review of Scottish Borders Council's handling of my FOI request 'SBC and Centeral Borders CAB.

I request the council disclose the pricing schedual information on the basis that the pricing reffered to that has been censored, is more than likely a reference to wanting, acquiring, or orherwise connected to my money that is to say the publics and therefore such information should be made public if this is the case. I ask that the signatures that have been apparently redacted be disclosed on the basis that the name of the people who allegedly singed these documents are already disclosed. Redacting the signature serves no real purpose for the purposes of HM Data Protection Act 1998 also such signatures were given to the public service/ placed on the documents purportedly for the contract of a service for the public. These signatures should therefore be evidenced to the public.

Dear Scottish Borders Council,

I have given the council a request for review of a lawful freedom of information request, I note the council has not responded to it within a timely nor legal fashion. I personally believe this is ridiculous and shoddy at best and stalling for time to protect Borders CAB and its council rep at worst. Therefore I have forwarded this to HM Freedom of Information Commissioner for her review.

Nobody can break the law or defend the indefensible.

I shall update HM Freedom of Information Commissioner for Scotland of the councils point of view and take legal council on the matter as I have been doing. However I am unhappy that the law has been broken in this matter by the council and must pursue this with authoritative examiners.

The council followed good practice when dealing with Central Borders CAB but not with members of the general public that give people in both organisations a job (failure to comply to carry out a review) this shows the a typical attitude of council towards business persons who live off the third sector and the man in the street.

Look at the DPA I accept that DPA rights must be upheld but it is again ironic that the persons who signed these documents in which can be viewed by council at leisure can not be seen by the main investors of council, again the man on the street.

As for asking the Galashiels outfit about the sensitivities of data, again its an ethical point and everyone is entitled to there opinion. I feel however that the arbitrator of the legality of disclosing these signatures should be the law as the application was made by law. Council staff should be competent enough in the law to make a safe enough decision about the law, if that be to disclose or withhold without deference to the CAB.

If anything, the the opinion of the signatures should have been sought as it is there information, well we would like to think so, it is in fact that they belong to the council/cab in law. It's not illegal but I feel it is a point of interest to note that information of ones self if given to central borders cab or council is no longer totally in the control of the author.
