Re my foi request for information as to the members of Jimmy
Saviles Friday morning tea club
your ref: FOI-20135/5184
You stated that my request "will now be considered and you will
receive a response within the statutory timescale of 20 working
days as defined by the Act, subject to the information not being
exempt."
This was on the 22 May.
I have not heard from you since and I believe West Yorkshire Police
are now in contravention of this Act, which you are obliged to
comply with.

Good Morning Mr Collyer,
Please accpet our apologies for the delay in responding to your request, this is largely due to high volumes of requests currently being received by our force. Please note we are actively processing your request.
Section 17 of the Act provides:
(1) A public authority which, in relation to any request for information, is to any extent relying on a
claim that information is exempt information must, within the time for complying with Section 1(1),
give the applicant a notice which:-
(a) states the fact,
(b) specifies the exemption in question, and
(c) states (if that would not otherwise be apparent) why the exemption applies.
The Freedom of Information Act 2000 obliges us to respond to requests promptly and in any case no later than 20 working days after receiving your request. We must consider firstly whether we can comply with S1(1)(a) of the Act, which is our duty to confirm whether or not the information requested is held and secondly we must comply with S1(1)(b), which is the provision of such information. However, when a qualified exemption applies either to the confirmation or denial or the information provision and the public interest test is engaged, the Act allows the time for response to be longer than 20 working days, if the balance of such public interest is undetermined.
In this case, we have not yet reached a decision on where the balance of the public interest lies in respect of either of the above obligations. We estimate that it will take an additional 20 working days to take a decision on where this balance lies.

I am writing to request an internal review of West Yorkshire
Police's handling of my FOI request 'Saviles Friday Morning Tea
Club'.
West Yorkshire Police have failed to give a substantive reply
despite 3 months passing since my original foi request.
West Yorkshire Police have yet again failed to reply within the
time schedule you set yourself in your last reply.
Do West Yorkshire Police not realise that trust in your
organisation falls, when you fail to tell the truth, and also to
comply with the law which you are supposed to uphold.

Dear Sue Freedom of Information,
Thank you for your response.
This is unprecedented in my experience.
West Yorkshire Police is breaking the law by not answering a
legitimate FOI request.
West Yorkshire Police are further breaking the law by not carrying
out an internal review.
If this is incorrect please state the part of the FOI Act or any
guidance that states that W Yorks Police may act like they are.
If your grievance is a genuine grievance about lack of staff, then
it indicates serious mismanagement by senior personnel at West
Yorkshire police.
Furthermore I would like evidence in the form of numbers of
requests, and numbers of staff, time taken to process requests and
time taken to train staff. Perhaps you can include this in the
internal review.
I note also that the internal review process is separate from the
original request and would appear to use different staff - are you
having problems with these staff too?If so please give details.
I note the request was 5 months ago, and is very simple.
I note also that it is a request that the West Yorkshire Police
might not wish to answer, especially if there is corruption within
the West Yorkshire Police.
I trust I will receive a speedy reply with the information I
requested and an internal review.

I write in response to your request for an internal review which

August 2013. The request for a review relates to the timeliness of
your Freedom of Information
request reference number above. Your original request was received
on 22nd May 2013 and I
note that to-date we have been unable to respond, for this I
sincerely apologise.
West Yorkshire Police has been experiencing some delays in
processing FOI requests due to
high volumes. A process of staff recruitment into the Information
Management Disclosure
department has now taken place, and newly recruited staff are
currently undergoing a full training
programme. All efforts are being made to ensure such delays are
kept to a minimum. I again
sincerely apologise for the delay in dealing with your request, I
can assure you that your request
is been given attention and we hope to respond to you as soon as
possible.

Dear Freedom of Information "Disclosure" Unit,
You have made no attempt to correct my statement that West
Yorkshire Police is not complying with the law.
As stated in my last email

I have had 6 months worth of excuses from a Police Force that
breaks the law. It would now be getting amusing, if the downside
was not so serious.
I notice the Daily Mail has provided two names Inspector Mick
Starkey and Sergeant Matthew Appleyard as being two of the Friday
Morning Club in an article on October 19th 2013.
Perhaps you could confirm these officers attended? Perhaps the
Daily Mail is the external third party that West Yorkshire Police
are consulting?
Maybe you should consider using twitter?

I believe the Mail Headline in the Newspaper is "Saviles Police
Protectors".
I can only assume West Yorkshire Police are proud to be known as
the Police Protectors of the most prolific Sex offender known, as
they fail to come up with half a dozen names in 6 months.
Please could you also release the correspondence from the FOI unit
to internal parties in West Yorkshire Police to show who the most
senior member of West Yorkshire is in charge of replying to this
request

"Only two police officers have so far been identified as a regular at those meetings, retired Inspector Mick Starkey (pictured with Savile top left) and Wetherby NPT Sergeant Matt Appleyard (left in centre picture).
"It is imperative that the rest of them are identified. The public have to be made aware who knew what, about Savile, within West Yorkshire Police. Savile claimed that Inspector Starkey was ‘his personal bodyguard’ so he has much to tell. He is one of two suspects that we have identified for the role of ‘Inspector 5′ referred to in the Operation Yewtree report."

There are also suspects for the officers of North Yorkshire Police, who appear to have been members of the "Club". The investigation, which the police does not wish to undertake, is being carried out by concerned members of the public.

"The report confirms inappropriate contact by Officers and Police staff of North Yorkshire Police who were based at Selby Police Station with Savile in 2008. This occurred when a police driver visited Savile’s Flat in Leeds in a police vehicle, which was used as a taxi to transport him to Selby in North Yorkshire for a public event organized by officers and police staff from Selby Police Station."
