your questions is set out below>

 

1 Please provide a copy of the SALT contract with health (ref Appendix 4)

 

A copy of the S&LT contract with Health is attached. This document has had
some information withheld, please find details below.

 

The rates tendered are commercially sensitive and cannot be released as
part of your request.  We are withholding this information as it is exempt
from disclosure under Section 43(2) of the Freedom of Information Act
2000, which provides that information is exempt if disclosure under the
Act would, or would be likely to, prejudice the commercial interests of
any person (including the public authority holding it). We recognise that
this exemption is subject to the public interest and so have considered
this accordingly. Whilst we recognise there is significant interest in the
spending of public funds, never more so than in the current economic
climate, we consider that the public interest in maintaining the above
exemption outweighs the public interest in disclosure. Disclosing the
pricing structure would be likely to prejudice the contractor's commercial
interests by giving an advantage to a competitor.  Whilst the County
Council appreciates that there is a strong public interest in the release
of information regarding County Council contracts, it believes that in
this case the greater public interest lies in withholding the information
in order to protect the commercial interests of both the County Council
and the contractor. The County Council believes the public interest lies
in ensuring normal market forces operate in this environment in order to
achieve the best value for any contract. Further, the County Council
considers that the public interest lies in ensuring that the County
Council is able to procure from the largest pool of bidders possible, to
elicit the most efficient spending of public funds and to achieve this,
contractors must not be deterred from engaging in procurement exercises
with the County Council for fear that commercially sensitive information
will subsequently be released by the County Council.

 

Individuals’ names, signatures and contact details have also been redacted
as they are personal data. As such we are withholding this information
under section 40 (2) of the Freedom of Information Act 2000 which exempts
personal information from disclosure if disclosure would breach one or
more principles of the Data Protection Act 1998. In this case we consider
that disclosure would breach the first principle, namely that personal
information must be fairly and lawfully processed and must meet one of the
conditions for processing as provided by schedule 2 of the Act. In this
case we consider that the disclosure would be unfair and unlawful and none
of the conditions for processing would be met.

2 Please provide a copy of the new Comprehensive Assessment of Need
document and revised assessment criteria (ref Appendix 4)

 

The Comprehensive Assessment of Need tool is still in the development
stage and is not yet available. It is anticipated that this work may be
completed by June 2014.

The second part of my request concerned the Comprehensive Assessment of Need tool and revised assessment criteria.

In a promotional email for the conference NYCC stated:

As a national pathfinder trialling the new developments, North Yorkshire will implement these new procedures in spring 2014 ahead of the legislation. This is the launch conference for that with national and local speakers and a range of practical workshops

8 Can you confirm that you have "implemented these new procedures" ahead of the legislation being enacted? If so, on what legal basis did you do this?

It is not clear to me how, if you were planning to implement in spring, the Can-Do system is not already operational.

1. Is the Comprehensive Assessment of Need ("Can-Do") tool a resource allocation system?

The CAN-Do© can be used to inform an indicative resource allocation.

2. Provide the revised assessment criteria.

The revised assessment criteria are contained within the CAN-Do© . The CAN-Do© system uses the assessment criteria within it to link to a financial model to allocate funding for individuals. This information is exempt from disclosure under Section 43(2) of the information Act 2000 as disclosure would, or would be likely to, prejudice the commercial interests of any person (including the public authority holding it). The Council has received interest in this system and hopes to market it at a future date. To disclose the contents of the system at this stage would prejudice the council’s ability to get best value when trading the tool as there would be no market for a system which was already freely available. Whilst the council acknowledges that there is public interest in openness and transparency in the spending of public funds and educating and caring for children and young people, consideration must be given to the prejudice, or likely prejudice, which applies at the time the request is received. The release of the assessment tool/information contained in the assessment tool about the product at this stage could seriously harm the council’s future commercial interests, and in the current economic climate, the public interest in this outweighs the public interest in disclosing the information at this stage. I attach a copy of the appeals procedure for your information.

3. Update me on the timeline for completion of the Can-Do.

The CAN-Do© is in a pilot phase which will take approximately 12 months.
Special Schools received training in the CAN –Do in the Spring Term 2014.
Training for School SENCOs is planned for the Summer Term 2014.
Early Years Settings to receive training in late Summer /Early Autumn term.
A report on the CAN-Do© will go to the Schools’ Forum in October 2014.
The CAN-Do© will be implemented from April 2015.

5. Please provide the evidence base for the Can-Do system.

The evidence base for the CAN-Do© is the framework of the International Classification of Functioning, Disability and Health (ICF). It is a framework for describing and organising information on functioning and disability. It provides a standard language and a conceptual basis for the definition and measurement of health and disability.

The ICF was approved for use by the World Health Assembly in 2001, after extensive testing across the world involving people with disabilities and people from a range of relevant disciplines. A companion classification for children and youth (ICF-CY) was published in 2007. The ICF integrates the major models of disability. It recognises the role of environmental factors in the creation of disability, as well as the relevance of associated health conditions and their effects.
 
The CAN-Do© has adapted the key statements within each category of the ICF to reflect a positive approach to identifying pupils abilities. This supports inclusive principles advocated by the Centre for Studies on Inclusive Education.

8. Can you confirm that you have "implemented these new procedures" ahead of the legislation being enacted? If so, on what legal basis did you do this?

North Yorkshire is one of 20 Government funded Pathfinders trialling aspects of the Children and Families Act ahead of the implementation of the legislation. We are ‘early adopters’ of the new assessment and planning procedures. With the informed consent of parents/carers or young people we will assess and plan for SEN using the Education, Health and Care Plan process from April 2014.

9. It is not clear to me how, if you were planning to implement in spring, the Can-Do system is not already operational. Can you explain?

The CAN-Do© is a locally developed tool and is not an essential part of early adoption of the Education Health and Care plan process at this stage. Please refer to our response to 3.

Thank you for your reply.

I am not clear how you are currently assessing children. The Council says it has moved to the new EHCP process - all children will go through this system with informed consent. You state in answer to question 9 that the CAN-Do is not an essential part of the early adoption of the Education Health and Care plan process at this stage, but the revised assessment criteria "are contained within the CAN-Do system" (question 2).

2 Please publish the criteria(s) you are currently using when not using the CAN-Do system.

3 How many parents/families have not given consent to use the EHCP process since the beginning of the summer term (i.e. April 2014)?

4 How many children going through the EHCP process are assessed using the CAN-Do system, and how many are assessed using another method?

5 Please provide the assessment criteria you use or used for children going through statutory assessment and statementing procedure.

6 Ref question 5: CAN-Do system - you have provided the evidence base for how children are classified and described, but no evidence for the effectiveness of CAN-Do as a resource allocation system to meet need. I would be grateful if you could provide it.
