Sale of leasehold properties

Response to this request is long overdue. By law, under all circumstances, Brighton and Hove City Council should have responded by now (details). You can complain by requesting an internal review.

Dear Brighton and Hove City Council,
On 1 October 2012 BHCC sold 52 '99 year leasehold properties' to Brighton and Hove Seaside Community Homes Limited (BHSCH). A BHSCH report, dated 14.9.15, states these properties were in need of refurbishment. The documents registered with Companies House and the Land Registry claim the properties were refurbished at the time of exchange. Please advise which description of the properties is correct

The Agreement is that up to 499 properties will be sold to BHSCHs. Some of
the properties are refurbished before completion and some are refurbished
post completion under a works agreement i.e. BHCC will undertake the
refurbishment works on behalf of Seaside Homes. It is down to capacity and
timing as to how many can be refurbished prior to completion of leases.

information we hold is as follows:

I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'Sale of leasehold properties'.

The answer given does not in any way provide the information requested. The information required is not what is claimed by BHCC or BHSCH but why is there a discrpencey between imformation held by Companies House, BHCC and BHSCH and what is the truth? The issue of whether a property had been refurbished or not, or even if it required refurbishment, at the time of its sale by the Council to the company is central to the value of the property.

Dear Councillors,

I write to you as our elected representatives on the Board of Brighton and Hove Seaside Community Homes.

On 29 November 2015 I submitted a request to BHCC under Freedom of Information legislation asking for an explanation of why information provided by Companies House and the Land Registry differed from statements made by BHSCH and BHCC.

Following a rather tortuous and lengthy correspondence with your department dealing with FOI requests I have received a final response (9.11.16) that is attached for your information.

I must emphasise my appreciation of the apologies and, more importantly, the explanation of the inadequacy of the replies provided by the Housing Department during the past year as explained by Katie Rees,Information Governance Officer.

During the past year I have requested BHCC to provide other information on BHSCH some of which has been provided and most refused on the basis that such information is not held by the Council. The ICO is currently investigating the rights and wrongs of the Council response.

I do not wish to waste the resources of Brighton and Hove City Council or the ICO by requesting an investigation into a refusal or inability to provide information to a number of questions covered by the same principle and therefore assume it is preferable to wait for a decision on the initial investigation by the ICO rather than submit a further issue to the ICO regarding the attached FOI request.

I am therefore asking that, if at all possible, you examine the attached FOI and respond to the questions put to BHCC regarding the contradictions between statements by the company upon which you represent the people of Brighton and the regulatory bodies established by statute.

I must also ask that you resolve the intolerable situation in which BHCC staff find themselves when refusing to provide information on BHSCH because it is not "totally owned by BHCC" although it is accepted that BHSCH cannot function without the support of, and agreement to detail by, BHCC.

I am sure that you agree transparency with regard to social housing is of great importance.
