For each sold asset, please also include:

–The sale price
–The buyer
–The date of sale

2) Please provide me with a list if all all the assets currently owned by the council in the same format (or please provide a link if publicly available).

information FOI: Sale of Council Assets. 

We confirm that the Council holds the information that you have requested.

1)            Please provide me with a list of all council-owned assets
that your local authority has sold in the previous five years, in Excel
spreadsheet form.

For each sold asset, please also include:

–The sale price

–The buyer
–The date of sale

 

2)            Please provide me with a list if all all the assets
currently owned by the council in the same format (or please provide a
link if publicly available).

 

 

We have considered your request, but are of the opinion that the exemption
under the following section of the Act applies to the information
requested:-

Section 25 - Information otherwise accessible

Information which the applicant can reasonably obtain other than by
requesting it under the Act is exempt information.

This exemption is an absolute exemption and therefore we are not obliged
under the terms of the Act to provide you with the information requested.

In regards to question 1, we have provided (attached) the addresses of
Council Assets that have been sold in the last five years. Information
regarding sale prices and the buyer is available from the Registers of
Scotland through their Land Information Service website -  [1]ScotLIS -
Scotland's Land Information Service. 

Regarding Question 2, Aberdeenshire Council’s Asset List is published on
Aberdeenshire Council’s website -

Please can you open an internal review into the council's refusal to share the information requested in question 1 to? Others councils have shared the equivalent information I requested, which I believe is the public interest. I would be grateful if your council could do the same.

The Council’s Internal Review Procedure provides for a Review Panel of
senior officers to consider written submissions from both sides.  If there
is anything more you wish to put before the Review Panel in addition to
the comments in your review request, please let me have that as soon as
possible and by no later than close of business on 11 December, 2019.  You
are entitled to have the decision of the Review Panel sent to you within
20 working days of my receipt of your email.  That means my reply with the
decision of the Review Panel has to be sent by 2 January, 2020.
