I am writing to request an internal review of University College London Hospitals NHS Foundation Trust's handling of my FOI request 'Salaries of directors within the ICT Department'.

I do not accept your exemption of this information under Section 40(2) of the freedom of information act. I also find your response slightly obscure in that you state it took significantly longer than 20 days to ensure the accuracy of my request however you completely exempted the information regardless.

I note that in a number of Decision Notices the ICO state that exact salary/remuneration details should be disclosed when in relation to 'senior' employees, and that the exemption at s40(2) of FOIA does not apply.

For example, DN FS50062124 states that, due to the seniority of the employee concerned, exact salary (and other remuneration) details that were requested should be disclosed. Also, in a recent DN (FS50229617) the ICO discusses the fact that senior employees should expect a greater level of scrutiny. Similarly in the 2013 First Tier Tribunal case of Dicker vs The IC (Appeal number EA/2012/0250) it was ruled that the exact salary of the chief executive be provided to the requester, which goes against what I believe is the current advice denoting that salaries be provided within a £5000 range - thus proving that the request was reasonable and valid. There are other examples of which you are no doubt aware.

If you read my request, point 1 does indeed request the exact salary of the ICT Director for every year between 2010 and 2017. I consider this to be a reasonable request and as referenced above would expect it to be answered, but can perhaps understand your trepidation. Exempting points 2 and 3 in which I requested the salary but included the phrase "or salary range" is, to my mind, somewhat in contradiction of the spirit of the act. Considering the ICO themselves disclose at least salary bands of ALL staff when requested I think that they would perhaps take a dim view on your refusal to provide the information requested.

Most every job advertised (certainly within the NHS) is posted with a salary band that a prospective employee can expect to receive in post. There is no difference in my mind between this and my request. At the end of the day the NHS is funded by public taxation and I believe we the British tax paying public have a right to know where our money is being spent, especially during these times of austerity.

However, due to extenuating circumstances surrounding the ransomware incident the NHS experienced over the weekend I am willing to extend the original deadline by 5 working days. After careful consideration of your internal review request, we have
decided to uphold our original decision. As such, we are continuing to
withhold the information requested under Section 40(2). While we
acknowledge that information relating to members of staff will not always
be personal information nor will it be sensitive personal, in this
instance the information requested does not relate to these staff members’
professional function. Staff members would have an expectation that this
information would not be released. The release of the information would
therefore be considered unfair and would be a breach of principle 1 of the
Data Protection Act.

 

We note your contention that there is a public interest in this
information being released. To an extent this is a true, however on
balance we believe in this situation that the exemption of sensitive
personal information that would allow the identification of staff members
and information relating to their personal lives outweighs the public
interest in the information being released.
