Please find attached the following safety audits:

 

o Stage 1 Safety Audit for Scheme 1 dated 8 July 2009 (refer to file
'full scheme stage1 July 2009.pdf').
o Stage 1 Safety Audit for Schemes 1, 2, 3, 4, 5, 6, 7 & 11 dated 9
November 2011. Note that Schemes 8, 9 & 10 were not audited as they
consisted of street lighting and traffic signing schemes only. (refer
to file 'full scheme stage1 Nov 2011.pdf').
o Stage 2 Safety Audit for Scheme 1 dated 29 August 2012 (refer to file
'scheme 1 stage 2 Aug 2012.pdf').
o Stage 2 Safety Audit for Schemes 2, 4, 5 & 11 dated 12 September 2012
(refer to file 'schemes 2 4 5 11 stage 2 Sept 12.pdf'). Note that
Scheme 7 has not yet been audited to Stage 2.
o Stage 2 Safety Audit for Schemes 3 & 6 dated 14 December 2011 (refer
to file 'scheme 3 and 6 stage2.pdf').

 

Please note the first stage 1 was carried out on the developer's
consultant's plans for Scheme 1.  Once the Major Projects design team had
received the schemes (1-11) as a package they had to be submitted for
stage 1 safety audit.  It was decided to include Scheme 1 for a new Stage
1 safety audit at the same time.

 

You will see that a small amount of the information has been redacted. 
This is because one of exemptions included in the Freedom of Information
Act 2000 applies to this information.  This letter acts as a refusal
notice in respect of the redacted information – further information on
this is provided in Appendix A below.

Personal information

 

Exemption applied

 

Section 40(2) of the Freedom of Information Act 2000 (FOI) provides that
any information to which a request for information relates is also exempt
information if it constitutes personal data, and either the first or the
second condition below is satisfied.

 

The first condition is in a case where the information falls within
definition of data under Data Protection Act 1998 (DPA), the disclosure of
the information would contravene any of the data protection principles or
Section 10 of the DPA.

 

In any other case, the disclosure of the information would contravene any
of the data protection principles if the exemptions in S33A(1) of DPA were
disregarded.

 

Reason why the exemption applies

 

In this case, the first data protection principle is relevant::-

 

1       Personal data shall be processed fairly and lawfully and, in
particular, shall not be processed unless—E+

(a)     at least one of the conditions in Schedule 2 is met, and

(b)     in the case of sensitive personal data, at least one of the
conditions in Schedule 3 is also met.

 

This principle has been considered, in particular whether release of the
information would be ‘fair’, taking into account:-

 

·        whether there is a legitimate interest in disclosure;

·        the legitimate interest can only be met, or fully met, by the
disclosure of the information which identifies individuals (i.e. the
disclosure is necessary to that purpose); and

·        the disclosure would not involve unwarranted detriment to the
individual’s privacy or other rights and legitimate interests.

 

The outcome of this consideration is that it is not considered that
release of this information would be fair.  This is for the following
reasons:-

 

·        The personal data concerned includes signatures of Norfolk County
Council officers contained in the documents covered by this request, which
are not already in the public domain.

·        The officers have not consented to the release of the personal
information contained in the documents covered by this request and have a
reasonable expectation it that it will not be disclosed.

·        The release of these signatures would not add value to the
information.

Dear FOI,

Thank you for your reply containing the information.

The document "Stage 2 Safety Audit for Schemes 2, 4, 5 & 11 dated 12 September 2012 (file 'schemes 2 4 5 11 stage 2 Sept 12.pdf')" also seems to be missing any mention of Scheme 5.

Please could you supply the stage 2 safety audit for Scheme 5? I am especially interested in the conversion of the Scania/Oldmedow T junction to a K junction that was recently done.

Thank you for your email received on the 21 March 2013 requesting further
information on Safety Audits: Hardwick Road/Scania Way schemes 2011-2013.

 

Our response is:

Scheme 5 includes the section of Scania Way from the new roundabout to its
junction with Old Meadow Road as it was included within the previous
safety audits, specifically the Stage 2 Safety Audit from 12/09/12.

 

Within the document "Stage 2 Safety Audit for Schemes 2, 4, 5 & 11 dated
12 September 2012 (file 'schemes 2 4 5 11 stage 2 Sept 12.pdf')" whilst
there is no mention of scheme 5 this does not mean it was not undertaken. 
Instead it means that there was no specific safety issues for Scheme 5
were identified at that time and therefore nothing added to the Stage 2
Safety Audit document.

 

Therefore we do not hold any further information relating to the Stage 2
Safety Audit for Scheme 5 and do not have anything to release to you.
