Our response is as follows:-

 

Please can you provide copies of the minutes from any Safety Advisory
Group meeting held in 2016 to date which reference or relate Charlton
Athletic Football Club.

 

 

“The Council holds the information you have requested and is withheld in
accordance with section 31 of the Freedom of Information Act 2000 (the
Act).

Section 31(1) (a) of the  Act,  states that information is exempt if its
disclosure would, or would be likely to prejudice the prevention or
detection of crime.

 

In respect to section 31(1)(a) of the Act, the information you have
requested refers to detailed discussions about both specific and general
policing operations during match days at Charlton Athletic Football Club.
We acknowledge the public interest in favour of disclosing the requested
information would be to increase transparency in the way the police
perform their functions, and to promote trust and confidence. We have also
considered the public interest  in favour of withholding the information
requested would be to prevent information from entering into the public
domain which could be used to counteract policing operations, and to
protect the ability of the police to enforce the law. Further, we have
considered the following factors:

 

1.      That the information requested relates to policing at a large
venue

2.      That the public would feel more vulnerable to the exposure of
crime if the information were released into the public domain, and

3.      That there are significant levels of potential criminal activity
taking place in or around Charlton Athletic Football ground.

 

Having weighed the above factors, our view is that the public interest
falls in favour of not disclosing the information you have requested.”

I am writing to request an internal review of Greenwich Borough Council's handling of my FOI request 'Safety Advisory Group Meeting Minutes - Charlton Athletic Football Club'.

In particular, please can Greenwich Council provide all the meeting minute headings and the justification regarding which meeting minutes subjects are being redacted under section 31(1)(a) for all sections of the SAG meeting, Police matters are discussed at SAG's but I wish to stress that the SAG also exists to discuss other matters of public interest from other parties, not just the MPS relevent to the subject. Taking each of the points provided in the justification from Greenwich:

1. That the information requested relates to policing at a large venue

I have obtained from Brent council the SAG meeting minutes for Wembley Stadium for 2016 through an FOI request among others. The capacity of Wembley Stadium is over double that of The Valley. The point being made by Greenwich Council is neither here nor there and SAG's are convened for stadia with standing/seating arrangements & capacity above a certain threshold. The level of attendance of capacity of an event is not an exemption clause for non disclosure of information under FOIA2000.

2. That the public would feel more vulnerable to the exposure of crime if the information were released into the public domain

Subjective assumption based upon which data and what information?

3. That there are significant levels of potential criminal activity taking place in or around Charlton Athletic Football ground.

Again a subjective assumption with no tangible evidence. If reference is being made in response to my FOI request to the ongoing protests against the current owner of Charlton Athletic, I wish to stress that no criminal activity has taken place to date in relation to these protests. If the council believes "significant levels" of criminal activity, potential or otherwise have transpired then the council will have access to MPS data relating to this, or its own information. As part of the internal review I wish to ask the council to review this and respond back to me either confirming that hard data exists to back the councils assumption regarding "significant levels" of criminal activity or to confirm that the council does not possess nor have access to such information and the justification provided to myself is based on assumption, rather then fact.
