I understand that the allegation was eventually withdrawn.

There is no data protection issue here. The issues referred to were discussed in an employment tribunal and published recently in the ET Judgement - which means that it is already in the public domain.

Thank you for your response.
I note that you say that In considering my appeal you have considered ,amongst others, the following document:
Employment Tribunal Judgement.
You will have noted from the Judgement that a meeting of the school safeguarding strategy group was held on 24th February 2016. There was also a follow up meeting of the group on 25thFebruary 2016. The purpose of these meetings was to deal with child protection allegations made against [potentially defamatory material removed].
The Chair of Governors, Rosa Lazell, informed the Tribunal that she had received advice from the HR Officer regarding the need for an independent investigation to be carried out into the allegations, in line with Welsh Government Regulations on Safeguarding issues. [potentially defamatory material removed] [potentially defamatory material removed] [potentially defamatory material removed]

I do not need you to confirm or deny that the information exists. It has been stated in a public meeting that it does exist.

What is not evident are the dates of when the school was advised of the withdrawal allegations of the Child Protection issue and the date when the responsible officer of the authority for dealing with such issues was advised of the withdrawal.

You state in your response that 'The Local Authority has a duty to ensure that the safeguarding records, and the protection of that information is maintained and our duty to protect those involved in any safeguarding
concern is of paramount importance'.

It is my belief that the reason why the Council is failing to provide this information is nothing to do with any of the various sections of the laws you are quoting. It is so easy to try and hide behind legal jargon - taking into account the number of 'solicitors' employed by the Council.

It is my belief that the reason for withholding this information relates to the fact that such revelation may show that the Council has failed in its duty of care in this issue of safeguarding a pupil at Ynysowen School (this is not disclosing information that is already in the public domain - i.e. Tribunal Judgement).

I would again ask that you provide the information required.

If you will not provide me with the information, perhaps you will be prepared to give the in formation to the Wales Audit Office, Estyn, Care Wales or Welsh Government.
