Please could you provide details and associated risk assessment criteria
of all applications / proposals where S66 of the Highways Act 1980 has
been utilised as a basis for approval / refusal of a structure on a public
right of way.
The County Council does not keep a specific record of barriers, posts,
rails and fences erected in or alongside public footpaths and bridleways
pursuant to section 66 of the Highways Act 1980. Whilst many structures
erected for safety reasons will be recorded in our rights of way database,
currently there is no identifier in the database which allows structures
to be tagged as being authorised under s66. Consequently we are unable to
provide the information requested.
