S444 education Act procedures
Dear Surrey County Council,
Please provide the following information valid currently and in the last 18 months.
Policy guidance etc (Inc any flow diagrams) used in the council or issued to schools.
Policy relating to witness statements and how they are written
Policy relating to witness payments and how they are to be paid etc
Policy about what patents are prosecuted or issued with a fpn / tpn.
One of your local schools have paid expenses for a head teacher from school funds. This is clearly a procedural impropriety.... Witness payments should be paid via the court system by completing a form at the magistrates court.
Witness expenses are not school expenses so misappropriation of school funds applies.

There is no written policy regarding witness payments. The Criminal
Procedure Rules and Practice Directions available on the Ministry of
Justice website at

would apply to a witness summons issued by the Court upon the request of
one of the parties.
